Comments:
An unannounced code compliance inspection for the religiously exempt child day center was conducted on 10/16/2023. There were a total of 3 children, ages 3 years-6 years and 3 staff present during the inspection. A total of 3 children?s records and 5 staff records, as well as other required documents were reviewed during the inspection. The children were observed arriving to the center, during handwashing and having an afternoon snack. The inspector arrived at 2:00 pm and departed at 4:20 pm.

Information gathered during the inspection determined non-compliance with the Code of Virginia and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.031-A-5-d
Description: Based on observation and record review, the center failed to ensure that any child, up to age eight, whom is being transported in provided with and properly secured in a child restraint device of a type which meets the standards adopted by the US Department of Transportation.

Evidence: Three children were observed arriving to the center via the center?s minivan. The children were not provided with and properly secured in a child restraint device. All three of the children being transported were determined to be under the age of eight years.

Plan of Correction: 3 booster seats were purchased and placed in the van today for use. Every student under the age of 8 that we enroll hereafter, a seat will be purchased before they ride.

Standard #: 22.1-289.035-B-2
Description: Based on document review and staff interviews, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence: Staff 2 verified that Staff 1 was hired in January 2023. There was not an eligibility letter for Staff 1 available for review during the inspection. Staff 1 was observed working during the inspection.

Plan of Correction: She is scheduled to retake this Thursday and results should be in by the following week.

Standard #: 22.1-289.049-A
Description: Based on record review, the center failed to ensure that upon enrollment of a child in a regulated child day program, the center shall require that the person enrolling the child presents the program with the proof of the child?s identity and age.

Evidence: There was no documentation of identity and age in the record for Child 3.

Plan of Correction: I spoke with the child's mother today, 10/17/2023, and she will bring in the birth certificate this week for review. Going forward, we will be using the model form from your website with all admissions.

Standard #: 8VAC20-770-40-D-2
Description: Based on staff interviews and record review, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation and to obtain the findings from a search of the central registry within 30 days of employment.

Evidence:
1. Staff 2 verified that Staff 4 was hired on 05/30/2023. There was not a sworn statement or affirmation in the record for Staff 4 available for review during the inspection. A sworn statement or affirmation was not obtained prior to the persons employment.
2. Staff 2 verified that Staff 4 was hired on 05/30/2023. There was no findings from a search of the central registry for Staff 4 available for review during the inspection. Findings from a search of the central registry were not obtained within 30 days of employment.

Plan of Correction: The statement was filled out and signed 10/16/2023 by the employee. Going forward all employees, no matter their age, will have this filled out and signed prior to hire.The employee was registered in the portal 10/16/2023, she filled out her part and I paid the fee all on the same day. We are waiting to receive her background check.
