8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Comments:
A subsidy health and safety inspection were initiated on 10/31/23 and concluded on 10/31/23. There were 59 children present, ranging in ages from two months to five years, with 16 staff. The Inspector reviewed five child?s records and five staff?s records. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies. One repeat violation was found.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 8VAC20-790-550-2-a
Description: (REPEAT VIOLATION) Based on record review and interview, the center failed to obtain results of the Virginia Child Protective Services Central Registry check within 30 days of employment.

Evidence:

1. The record for staff 5 documents the employment date as 4/5/22. The central registry results are dated 7/7/22.
2. The director verified the employment date and central registry date.

Plan of Correction: Staff will be required to provide documentation to complete central registry background checks prior to the first date of working at the center and the documentation will be processed within seven days.

Standard #: 8VAC20-790-550-2-b
Description: Based on record review and interview, the center failed to request the results of the child abuse and neglect registry from any other state in which a new staff member has resided in the preceding five years.

Evidence:

1. The record of staff 4 documents the employment date as 1/24/23. The sworn statement signed by staff 4 states staff 4 lived in an other state within the preceding five years. The record did not contain documentation of a child abuse and neglect registry check for that state.
2. The director verified an out-of-state background check was not completed for staff 4.

Plan of Correction: The documentation for the out-of-state background check will be processed for staff 4 within 10 days. The results will be sent to the licensing inspector.
In the future out-of-state background checks will be completed within the required timeframe.

Standard #: 8VAC20-790-550-2-c
Description: Based on record review and interview, the center failed to obtain the results of a criminal history record check prior to the first day of employment from any state in which the new staff member has resided in the preceding five years.

Evidence:

1. The record for staff 4 documents the employment date as 1/24/23. The sworn statement completed by staff 4 stated staff 4 lived in another state within the preceding five years. There was no documentation of a criminal history record check being completed for staff 4 in the other state.
2. The director verified a criminal history background check was not completed for the other state.

Plan of Correction: The documentation for the out-of-state background check will be processed for staff 4 within 10 days. The results will be sent to the licensing inspector.
In the future out-of-state background checks will be completed within the required timeframe.

Standard #: 8VAC20-790-560-A
Description: Based on record review and interview, the center failed to ensure TB screenings were completed for staff within 30 days of the date of employment.

Evidence:

1. The record for staff 5 documents the employment date as 4/5/22. The TB screening documentation was dated 5/4/22

Plan of Correction: Staff will be required to provide documentation of a TB screening prior to starting work.

Standard #: 8VAC20-790-600-B
Description: Based on record review and interview, the center failed to ensure new staff complete within 90 days of employment the Virginia Preservice Training for Child Care Staff.

Evidence:

1. The record for staff 3 documents the employment date as 1/23/23. The certificate of completion for Virginia Preservice Training for Child Care Staff is dated 7/14/23.
2. The director verified the employment date and certificate date.

Plan of Correction: From now on all staff will be required to complete the preservice training within 90 days of employment.
