Comments:
An unannounced monitoring inspection was conducted with program staff and the Director on 12/4/23 from 9:30am to 10:20am in response to a self-report made by the program related to supervision. A walk through of the related rooms was conducted, an interview was conducted, documentation was reviewed, and one staff record was reviewed. The inspection resulted in one violation that can be reviewed on the Violation Notice. Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for each violation cited and return to me by close of business on 12/12/23. Plans of correction should include steps to correct the noncompliance with the standard, and measures to prevent the noncompliance from occurring again.

Violations:
Standard #: 22.1-289.031-B-2
Description: Based on review of documentation and interview, the program did not implement their procedures for appropriate supervision of all children in care. Evidence: On 11/28/23, from approximately 2:55pm until 3:00pm, Child A, a two-year-old, was left unsupervised in a bathroom. The program?s bathroom supervision policy states, ?As a safety precaution, students are to be accompanied to the bathroom or watched from the door. No child should be sent to the bathroom alone?One teacher must always remain at the entrance of the bathroom, when a child is present.? The Director reported that staff are also trained to do a headcount of the children before leaving a location and upon arriving at another location. At the time of the incident, there were 10 children present with Staff #1 and Staff #2. Staff #2 took the children?s cots to storage down the hall and around the corner, and Staff #1 sent Child A to the restroom in the hall approximately five feet away from the classroom doorway, and then left the doorway to sit on the carpet with the other children. Then, at approximately 2:55pm, Staff #1 and Staff #2 took nine children down the hall, through a door, and down another hall to the program?s indoor gym space. A headcount was not conducted in the classroom or upon arriving at the gym. At approximately 3:00pm Child A was discovered crying in the bathroom by Staff #3.

Plan of Correction: The director and assistant director are revising the staff handbook to include a section with general procedures to be followed to include a supervision specific
policy that indicated a frequency in which teachers count their students every 10
minutes and every time they go through a door.

The next Staff meeting will include a thourough walk through our revised staff
handbook. A New Teacher Orientation guideline will be created to include a checklist of the daily tasks that a teacher must do to continue to maintain a safe and loving facility.

Both Staff 1 and Staff 2 have been terminated as of 11/29/23
