Technical Assistance:

The administrator must send evidence to the licensing inspector that the background checks have been requested by January 5, 2023 (reopening after the holidays). The applicant must also then forward the results to the licensing inspector upon receipt. The following need to be received BEFORE you can hire someone: 1. fieldprint fingerprint results 2. completed sworn statement 3. if the person has lived outside of VA within the past 5 years you need their out-of- state criminal background search results and the sex offender registry search results from any state they have resided in. You do not need the social services child abuse and neglect registry search (Virginia or out-of- state) back before hire ? but they do need to be received by the end of their 30th day of employment for VA Central Registry and by the end of 45 days for any out-of-state registries. Also, if someone has resided out-of-state in the past 5 years, if that state is highlighted in red on the out-of-state background check contact sheet you do not have to complete the criminal background search for that state but still have to complete the sex offender registry search and the child abuse and neglect registry search. If the state is listed in black, you have to complete all three.

Comments:

An unannounced monitoring inspection was conducted on 12/7/2023 from 11:00am-12:15pm. At the time of entrance, 62 children were in care with 11 staff members present. The sample size consisted of 10 staff records. Children were observed watching a Holiday Program in the sanctuary, eating an afternoon snack, participating in activities and transitioning for pick up by families. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program Repeat violations were found and are identified within this report.

Description:	***REPEAT VIOLATION*** Based on a review of records, the exempt program did not ensure that, for each staff person, a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years is present in their record. Evidence: 10 staff records were reviewed. The record for staff #7, contained a Sworn Disclosure Statement dated 9/20/2022 that indicated that staff #7 resided in California within the previous five year period. The record for staff #7 did not contain a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from California. The record for staff #9 contained a Sworn Disclosure Statement dated 8/22/2023 that indicated that staff #9 resided in Texas within the previous five year period. The record for staff #9 did not contain a sex offender registry check, and a criminal record from Texas. The record for staff #10, contained a Sworn Disclosure Statement dated 9/20/2022 that indicated that staff #10 resided in Georgia within the previous five year period. The record for staff #10 did not contain a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from Georgia. The interim director was unable to locate these background check documents during the inspection and confirmed that they were not in the staff records.
