Comments:
A complaint investigation was initiated on September 6, 2023, and concluded on January 16, 2024, in response to a complaint received by the Department on August 30, 2023, regarding supervision of a child. The licensing inspector and other local agencies were onsite conducting an inspection on September 6, 2023. Interviews with staff were completed, observations were made at the center, and documentation was reviewed. Additional interviews were conducted on September 19, 2023, September 22, 2023, September 26, 2023, and December 21, 2023.

The preponderance of evidence gathered during the investigation does support the complaint; therefore, the complaint is determined to be valid.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice. Sign and return to me within 5 business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance, 2) measures to prevent the noncompliance from occurring again; and 3) identify person(s) responsible for implementing and monitoring any preventive measures.

Standard #: 22.1-289.031-A-5-c
Complaint related: No
Description: Based on staff interviews, documentation review and review of recorded video footage, the center failed to report suspected child abuse in accordance with ? 63.2-1509 of the Code of Virginia.

Evidence:
On August 21, 2023, Child A (five years of age) was left alone and unsupervised on the bus from approximately 2:45pm until 6:00pm.
Wunderground website indicated the temperature on that date and time was 93 degrees Fahrenheit at 3:00pm and 89 degrees Fahrenheit at 6:00pm.
Staff #3 stated when Child A was located on the bus at approximately 6:00pm ?sweat pouring off [child]? and Child A said they had wet their self.
Staff #2 stated they felt leaving the child on the bus unattended under the circumstances was child neglect.
Staff #2 did not immediately report the incident to the local agency. They did not make the report until 08/30/2023.
The Code of Virginia requires any person providing full-time or part-time child care for pay on a regularly planned basis who have reason to suspect that a child is an abused or neglected child, shall report the matter immediately to the local department.

Plan of Correction: Per the Center: "Crisis Reporting
The St. Peter Baptist Church Child Development Center revised Emergency Guide was completed in August 2023. The revised guide authorizes the Building Leadership and staff members to act, in the absence of the Director.
--Director or designee will immediately look for unaccounted children (full-sweep). Call 911 to report a missing child, notify the parent and if abuse/neglect has been suspected, contact CPS within 24 hours.
--The instructions for responding to an Accident/Injury of a Child (Page 4 of the Revised Crisis Plan) states that all personnel must be certified in First Aid and CPR.
-In the event of a health crisis, all personnel shall apply immediate, appropriate care, as instructed/trained to check the child?s vitals, as well as calling 911 . Notify parent(s) or close relative.
--All staff members that attended the 2023 workshop were provided with a copy of the Child Abuse and Neglect Recognition and Intervention Training Curriculum Guidelines.
The urgency of Crisis Reporting was relayed at the workshop and will be stressed at future workshops. Accurate and immediate write-ups were also emphasized to ensure proper documentation."

Description: Based on review of staff records and interviews, the center did not ensure a person trained and certified in first aid and cardiopulmonary resuscitation (CPR) was present at any other location in which children attending the child day center were present.

Evidence:
The record for Staff #1 (Date of Employment 06/16/2022) did not contain documentation of training and certification in first aid and CPR.
Staff #1 was alone with 11 children on 08/21/2023 while driving the bus.
Staff members confirmed Staff #1 did not have first aid and CPR training and certification.

Plan of Correction: Per the Center: "--Staff members (#3,#4,#5,#6,#7) at the SPBC-CDC are trained and certified in First -Aid and CPR.
Employment Checks
--All employees for the St. Peter Child Development Center must be trained and certified in first aid and cardiopulmonary resuscitation (CPR).
--Documentation of employees or perspective employees? (CPR) training must be obtained before driving for the CDC.
-- A certified driver will accompany an employee who has not received CPR training until that training is obtained.
--Document the Review of training requirements and updated training will be provided prior to expired dates of certification."

Description: Based on staff interviews, documentation review, and review of recorded video footage, the center did not establish and implement procedures for appropriate supervision of all children in care, including daily intake and dismissal procedure to ensure safety of children.

Evidence:
Five staff stated that on August 21, 2023, Child A (five years of age) was left on the center?s transportation bus between approximately 2:45pm until 6:00pm.
Staff #1 stated they were driving the center?s bus and arrived at the center at approximately 2:45pm with 11 school age children on the bus. Staff #1 stated they dropped off the children by the school age door with the school age teacher. Staff #1 stated they then parked the bus in the parking lot, they did not check the bus and did not realize Child A was still on the bus.
Witness #1 stated they arrived at the center to pick up Child A at approximately 5:30pm and was told by staff that Child A was not at the center. Witness #1 stated they left center to search for Child A at the nearby elementary school.
At approximately 6:00pm, recorded video footage shows three staff members exiting the center?s building to look on the bus for Child A. The three staff members stated Child A was located in one of the seats at the front of the bus.

Plan of Correction: Per the Center: "Policies and Procedures
The policies and procedures regarding the daily intake, dismissal and transport of children were reviewed in the ?Driver?s Workshop? held on August 17, 2023
--Staff #1 (CDL Driver) attended the workshop. Non-compliance with the specific directives detailed in the ?Driver?s Workshop? led to the release of Staff #1.
Enhanced Policies and Procedures
--Require staff attendance for formal training before operating any CDC?s vehicles.
--Signage required by driver and the receiving teacher, listing the names of students who boarded as well as departing the vehicle.
--Immediate attendance recording of all students in the after-school program on ProCare (attendance software).
-- After parking the bus, the driver will walk the entire length of the bus to check for sleeping students, vandalism and forgotten articles. Initial all paperwork to record that the procedure has been followed. If a parent or guardian comes to the Child Development Centers to pick up a child whose attendance is unrecorded, immediately do a full-sweep search of the facility, grounds, and vehicles.
--Maintenance of Driver?s Handbook to record daily reporting of drivers and incidence and any safety concerns."

Description: Based on review of seven staff records and interview, the center did not obtain satisfactory results of a fingerprint-based national criminal background check for one staff member prior to employment.

Evidence:
The record for Staff #1 (Date of Employment 06/16/2022) contained the results of the fingerprint-based national criminal background check dated 09/15/2022.

Plan of Correction: Per the Center: "Employment Checks
All employees and prospective employees of the St. Peter Baptist Church Child Development Center must pass the mandated background check, the finger-print national criminal background check prior to employment. Signage from employees will be required on the Staff Orientation Document.
--Documentation of persons background information must be obtained before they drive for the CDC.
-Employment verification will not be provided until the national criminal background check has been completed."
