8VAC20-770 Background Checks

An unannounced Subsidy Health and Safety inspection was conducted with the director on November 16, 2023 beginning at 11:28 a.m. and ending at 1:42 p.m. There were 71 children, ages 6 months through 5 years old, in care during the inspection. The children were observed playing with age-appropriate toys and doing instructional work. Five children's records were in compliance. Five staff records were reviewed. There were no medications on site to be reviewed. The first aid kit, flashlight, and battery radio were reviewed and in compliance. The most recent health inspection was dated 5/16/2023. The most recent fire inspection was dated 5/17/2023.

Standard #: 22.1-289.035-B-2 Description: Based on a review of three staff records, the center failed to obtain fingerprint background checks as required. Evidence: Staff A (start date 9/11/23), staff B (start date 8/16/21), and staff C (start date 8/3/22) did not have documentation of completed fingerprint background checks in their records. Plan of Correction: The facility had conducted background checks through a company that was not approved by the Division. The facility will have new background checks completed through the approved vendor.
Standard #: 8VAC20-770-40-D-2 Description: Based on a review of three staff records, the center failed to ensure that a sworn statement prior to the first day of employment and a central registry background check was obtained within 30 days of employment. Evidence: Staff A (start date 9/11/23), staff B (start date 8/16/21), and staff C (start date 8/3/22) were missing documentation of central registry background checks from their records. Plan of Correction: The central registry background checks were no conducted on the staff but will be requested as soon as possible and the results will be placed in the records.
