The Virginia Department of Labor and Industry (DOLI) approved an Emergency Temporary Standard that requires all staff in child care settings to wear cloth face coverings.

Pursuant to the Governor's Executive Order 63, all children ages five and older are required to wear face coverings while indoors at child care programs. While not required, children ages two through four are strongly encouraged to wear face coverings while indoors, especially if children are in close contact. This is a best practice that will decrease the risk of COVID-19 transmission when children and caregivers are in close proximity.

Programs that remain open are to adapt service settings to align with public health recommendations, which include social distancing, wearing face coverings, implementing robust policies and procedures for hand washing and cleaning and disinfecting frequently touched surfaces and materials. Review all information from Virginia Department of Social Services (VDSS), Virginia Department of Health (VDH) and the Centers for Disease Control and Prevention (CDC) regarding COVID-19 updates.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was conducted on 1/26/21 with an exit interview on 1/29/21. The provider was contacted by telephone and a virtual inspection was conducted. There were six children present, ranging from ten months to six years of age, for a total of 14 points. The Inspector reviewed four children's records, four caregiver/household member records, the emergency drill log, hand washing procedures, naptime, enhanced cleaning and sanitizing of toys and surfaces, meals and snacks, and daily indoor and outdoor activities. The information gathered during the inspection determined non-compliance with standards that are documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-111-100-A
Description: Based on a review of four children's records, the provider did not obtain documentation that each child has received a physical examination by or under the direction of a physician prior to the child's first attendance or within one month after attendance. Evidence: the record for child #2 (date of first attendance: 8/24/20), child #3 (date of first attendance: 9/21/20) and child #4 (date of first attendance: 9/21/20) did not have documentation of a physical examination.

Plan of Correction: Provider stated she will obtain the missing information.

Standard #: 22VAC40-111-60-A
Description: Based on review of four children's records, it was determined that not all records contained all required information. Evidence: the records for child #3 and child #4 did not have mom or dad's work phone number and address. The record for child #2, #3, and #4 did not contain signed acknowledgement of the receipt of information regarding the provisions of the family day home's emergency preparedness and response plan.

Plan of Correction: Provider stated she will obtain the missing information.

Standard #: 22VAC40-111-90-A
Description: Based on a review of four children's records, the provider did not obtain documentation that each child has received immunizations prior to the child's first attendance. Evidence: the record for child #4 (date of first attendance: 9/21/20) did not have documentation of immunizations.

Plan of Correction: Provider stated she will obtain the missing information.

Standard #: 22VAC40-111-170-A
Description: Based on review of four caregiver/household member records, the provider did not have documentation of a tuberculosis (TB) test or screening for all adult household members. Evidence: the record for household member #3 (date of birth: 6/1/2002) did not have documentation of a TB test/screening.

Plan of Correction: Provider stated she will obtain the missing information.
