Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was initiated on 09/30/21 and concluded on 10/28/21. The provider was contacted by telephone and a virtual inspection was conducted. There were six children present with two caregivers supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of two child records and two caregiver records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-111-30-A
Description: Based on observation and interview, the provider did not ensure compliance with these standards and the terms of the current license issued by the department and with relevant federal, state or local laws, and other relevant regulations.

Evidence: 1) The licensing inspector observed that the provider's zoning permit requires a conditional use permit for any family day home that employs persons from outside the home. 2) During interview, Caregiver #1 reported she does not have a conditional use permit from zoning to authorize the provider to employ a caregiver who is not a resident of the home. Caregiver #1 reported Caregiver #2 does not reside in the home.

Standard #: 22VAC40-111-140-B-3
Description: Based on a review of records and interview, the provider did not ensure that one provider and a substitute provider had current certification in cardiopulmonary resuscitation (CPR).

Evidence: 1) The most recent CPR certification in the record for Caregiver #1 was dated 09/13/2019 and expired on 09/13/2021. 2) The most recent CPR certification in the record for Caregiver #2, sometimes a substitute caregiver, was dated 09/13/2019 and expired on 09/13/2021. 3) During interview, Caregiver #2 confirmed the certifications had expired and had not been renewed.

Plan of Correction: A new certification was obtained on 11/01/21.

Description: Based on a review of records and interview, the provider did not ensure that one provider and a substitute provider had current certification in first aid.
