Comments:
A monitoring inspection was conducted by licensing staff using an alternate remote protocol, including telephone contact, interviews, and a document review of the program.

This inspection was initiated and concluded on 01/11/2022. The Provider was contacted by telephone and an inspection was conducted. There were no children present, with 1 caregiver. The inspector reviewed compliance in the areas of administration; physical plant; staffing and supervision; programming; special care and emergencies; and nutrition. A total of 1 household member record, and 1 staff record was reviewed. Due to zero enrollment, no children files were available for review.

Information gathered during the monitoring inspection determined that there was (1) one non-compliance with an applicable standard. This violation was documented on the Violation Notice issued to the program.

Violations:
Standard #: 8VAC20-770-40-D-1-c
Description: Based on review and interview, 1 of 1 staff file, and 1 of 1 household member file indicated that the family day home (FDH) did not obtain a search of central registry (CPS check) before five years since the dates of the last central registry finding on file.

Evidence -
1. On the date of inspection (01/11/2022), the current CPS check on file for Staff #1 was dated - 07/25/2016; and Household Member #1 was dated - 07/25/2016.
2. During a inspection conducted on 08/03/2021, the Provider stated that those (2) two requests of a search of the central registry had been sent. During an interview conducted on the date of inspection (01/11/2022), the Provider stated that she contacted OBI to inquire the status of those checks sent. OBI responded that they received no information. New checks were then sent again in October. As of the date of inspection, no finding has been returned, nor was a further status check was made by the Provider. As of 01/11/2022, the two expired CPS checks for Staff #1 and Household Member #1 were the most current CPS checks on-site at the FDH.

Plan of Correction: OBI will be called to find out about requests sent. If needed, new requests will be sent again. LI will be contacted to tell him the status of these requests.
