Technical Assistance:
Advised that possible enforcement actions may occur as a result of complaint violations.

The provider must send documentation that staff enrolled in English classes.

Discussion on standards on safe sleep, handwashing, physical plant and staff training, process of hiring an assistant.

Technical assistance today included background check information and attendance procedures

Comments:
A complaint was received in the licensing office on June 14, 2023, regarding supervision for a 5-year- while in care. On June 28, 2023, an on-site investigation was conducted with another local agency. Interviews were conducted and observations were made.

Based on the preponderance of the evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Standard #: 22.1-289.018-A
Complaint related: No
Description: Based on provider statement and action, the provider did not allow the Superintendent reasonable opportunity to inspect all of her facilities, books and records.
Evidence:
1.Provider prohibited the Superintendent representative/Licensing Inspector from seeing the full video of the incident on 6/09/2023.
2. Provider stated the video section was ?bad? when asked to review approximately 20 to 30 minutes of video that was not shared with Licensing.

Plan of Correction: I will corporate 100% with Licensing when asked information will show it.

Standard #: 8VAC20-770-60-C-2
Complaint related: No
Description: Based on staff records review, 1 out of 2 records reviewed did not contain documentation of a search of the central registry within 30 days of employment.
Evidence:
1. Staff #2 (date of employment 1/20/2023) did not have documentation of central registry results.
2. Staff #2 was alone and directly supervising two children during the inspection on 6/28/2023.

Plan of Correction: Background were completed and provided to Licensing.
I will not hire staff until all paperwork is completed.

Description: Based on observation and interviews, an assistant caregiver did not meet general qualifications for caregivers.
Evidence
1.Staff #2 was not unable to speak to Licensing in English. Provider acknowledged that Staff #2 spoke limited English and would be unable to communicate effectively with emergency personnel.

Plan of Correction: Staff was asked if registered for English classes. Staff will be given one week to registered for class and provided documentation. I will send documentation to Licensing.

Description: Repeat Violation

Based on observation and interview, the family day home provider did not maintain areas and furnishings of the family day home, inside and outside, shall be maintained in a clean, safe, and operable condition.
Evidence:
1. In the hallway, the subfloor sags when walking across the floor. Children walk through he hallway to go to the bathroom.

Plan of Correction: I spoke with landlord a month ago and request it is fixed within the next two weeks.

Description: Based on staff interviews and video camera recording, Staff #1 failed to provide direct care and supervision of each child at all times.
Evidence:
1. Child #1 (5 years old) went to use the bathroom approximately 3:55 pm. After leaving the bathroom, Household member #1 and Child #1 held hands and went in Household member?s #1 bedroom. Household Member picks up Child #1 and put her on the bed.
2. Household member and child were playing with Child #1 hitting household member with a pillow and covering Household Member with blanket while they were on the bed. During the time, Child #1 was in the bedroom, Household member displayed the following behaviors of pulling down pants while lying on the bed covered with a pillow and standing on the bed and showed their private part to Child #1.
3. Child and Household member were left unattended and unsupervised in the bedroom for approximately 25 or 30 minutes.
4. Staff #1 acknowledged she was on cellphone during the time Child #1 went to bathroom and was unaware of Child #1 in Household member?s bedroom.
5. Staff #1 was not near enough to intervene and offer assistance.

Plan of Correction: During the day, teachers go with children to the bathroom and wait for the child to return. Teachers will stand in the hallway to wait for the child.

Standard #: 8VAC20-800-580-A
Complaint related: Yes
Description: Based on interviews and video camera recording, the family day home failed to promote the child?s physical, intellectual, emotional and social well-being when caregivers did not provide needed help, comfort, and support.

Evidence:
1.Child #1 was exposed to Household member?s inappropriate actions when they exposed their private parts to Child #1 on 6/09/2023. When Child #1 shard the incident with the caregiver, the caregiver did not comfort the child.

Plan of Correction: Will provide hugs and fix the problem. We will talk to to the children and listen to them.
