Comments:
An unannounced inspection was conducted on 8/24/2023 in response to a complaint that was received by the licensing department on 8/23/2023 regarding allegations in the areas of supervision and licensed capacity. The inspector was on site from approximately 8:30 am to 9:05 am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed.

The preponderance of the evidence gathered during the investigation supports part of the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Description: Based on observation and interview, the provider did not ensure that the total number of children receiving care at any one time did not exceed the maximum licensed capacity of the home.

Evidence:
1. On 8/24/2023, 13 children were observed in care. The home's licensed capacity is 12.
2. The provider acknowledged that they had one child over their licensed capacity from approximately 8:25 am-8:57 am.

Plan of Correction: Requested a few parents with non school age children not to bring children until the bus has left. Will refuse children until school children have left.

Description: Based on review of documentation and interview, the provider did not ensure that a caregiver did not exceed 16 points by using the point system to determine if an additional caregiver was needed.

Evidence:
1. On 8/23/2023, the department received a complaint that one caregiver was observed in the home with 12 children, totaling 17 points for several minutes before another caregiver arrived.
2. The provider acknowledged that the caregiver was over their points for approximately five minutes on 8/23/2023.

Plan of Correction: Requested a few parents with non school age children not to bring children until the bus has left. Will refuse children until school children have left.
