22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Per ? 22.1-289.037 B of the Code of Virginia, failure to obtain background checks pursuant to ?? 22.1-289.035 and 22.1-289.036, shall be grounds for denial, revocation, or termination of a license.

Advised that possible enforcement actions may occur as a result of complaint violations.

Consultation was given on diapering and diapering supplies

Comments:
A monitoring inspection was conducted on January 22, 2024 to follow up on previous violations. There were 11 children children for a total of 25 points directly supervised by 4 staff.

Observation of staff supervision of children during the visit. Children were observed individual play, tummy time and a group activity. A total of 3 children records and 2 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Systemic Violation

Based on interview and a review of one staff member?s record, the provider did not deny
continued employment after a Virginia Central Registry finding was not received within 30
days.

Evidence:
1. Staff member 2 has been employed at the home since January 20, 2023, but did not have documentation of results of a search of the child abuse and neglect from Virginia.
2. Provider mailed submitted Central Registry results on November 15, 2023. Provider had no documentation of follow up request to obtain the results.
3. Staff member 2 was present at the family day home during the inspection. Interviews confirmed that Staff member 2 has been left alone with children in care to supervise them while provider and other staff members assisted other children and caring for infants.

Description: Based on observation, the provider did not ensure that diapering area had a nonabsorbent surface for diapering or changing.
Evidence:
1. The changing pad had a large hole in the top corner, exposing the absorbent cushion.
