Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 06/22/2020 and concluded on 06/29/2020. A complaint was received by the department regarding allegations in the areas of General Provisions, Personnel Records, Provider Homes, Children Services and Records Management. The Quality Manager, who was identified as being in-charge was contacted by telephone to conduct the investigation. The inspector emailed the Program Director and the Quality Manager a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the allegations of non-compliance with standards or law, and violations were issued. Any violations not related to the complaints but identified during the course of the investigation can be found on the violation notice.

Description: Based on the review of the personnel file for Staff-(1), an interview with S-5, an interview with S-1, and an interview with Reference (R)-1, the licensee failed to include at least two written references, notations of oral reference or record of interview with references for S1.

Findings:
1.The personnel record for S-1 contained one written reference from R-2 and one documented notation of oral reference for R-1. The documented notation of oral reference for R-1 was written by S-5 as evident by the electronic signature for S-5. S-1 was interviewed by the licensing inspector. During the interview S-1 reported to the licensing inspector that R-1 was never contacted to provide a reference and that the notation of oral reference located in the personnel file for R-1 was not accurate.
2.R-1 was interviewed by the Licensing Specialist. During the interview, R-1 denied ever being contacted by S-5 or any representatives from the licensee. On 06/25/2020, R-1 issued a written statement stating that the notation of oral reference located in the personnel record for R-1 was not accurate. In both a verbal and written account, R-1 denied that the reference was provided to the licensee.
3. During the exit interview, S-5 reported that she contacted R-1 by phone and left a voicemail message that stated ?Do you have any reservations about S-1?s employment.? During this interview, S-5 reported that R-1 called back and left a voicemail message stating ?I have no concerns.? During this interview, S-5 reported that she had ?no way of confirming if R-1? was the person who left this voice mail message. During the interview, S-5 stated that she was concerned regarding the use of the voice mail as a reference and followed up with S-1 by asking that she obtain a written reference however, S-1 never provided the written reference and S-5 never obtained a second reference for S-1.

Plan of Correction: Comments in this violation are taken out of context. A voicemail was received as a reference for S1. It is documented in the record. This violation is pending desk review.

Description: Based on the review of the record for Foster Child (FC)-1, an interview with Foster Home (FH)-1 and an interview with Staff (S)-2, the licensee failed to maintain documentation of the receipt of follow up medical and mental health as well as psychiatric care and treatment in the record for FC-1.

Findings:
1.During the investigation, the licensing inspector requested all medical records for FC-1 to be submitted for review on two separate occasions and followed up with a written request. During a telephone interview on 06/24/2020 at 9:30am, the licensing inspector requested that all medical documentation be submitted to the department for review.
2.During the interview with FH-1, FH-1 reported that there were repeated emergency room and urgent care visits from the date of placement until the last reported urgent care visit on 05/25/2020. At the time of the inspection none of this medical care was documented in the record as evident by the documents not being provided for review at the time of request.
3. During the interview, FH-1 reported that during a home visit on 06/22/2020, the newly assigned worker requested documentation of all medical visits, took them to the office to be copied and placed in the record.
4. At the time of the inspection, there was no documentation of follow up medical and follow up mental health care/psychiatric care and treatment in the record for FC-1.

Plan of Correction: S1 failed to perform job responsibilities including but not limited to following up with FH1, returning phone calls, and texts, and did not obtain follow up documentation of any medical visits. Once the home was reassigned to another worker, that worker obtained all documentation and it is currently in the file.
