Comments:
A complaint investigation was initiated on January 23, 2020 with another local agency and ended on February 7, 2020 regarding non-compliance with meals and nutrition, activities, and restrictive devices. Interviews and observations were conducted, and documentation was reviewed. There was a preponderance of evidence to support the allegation regarding meals and nutrition and restrictive devices. Therefore, the complaint was deemed valid. The complaint related violations and non-related violations are identified in the Violation Notice.

Standard #: 22VAC40-111-750-A
Complaint related: No
Description: Based on observation, topical skin products were accessible to children.

Evidence:
1. A drawer underneath the diaper changing table contained children's diaper creams.
2. Child #1 (age: 21 months) was observed opening up the drawer containing diaper creams and grabbing the diaper cream containers.

Plan of Correction: Locks have been added to the drawers on the diaper changing station.

Description: Based on observation and staff interview, the family day home did not schedule snacks or meals so that there is a period of at least 1-1/2 hours, but no more than three hours, between each meal or snack.

Evidence: Lunch was served at approximately 1:00pm. Staff A and Staff C stated that the last time the children ate was at approximately 8:00am.

Plan of Correction: We were busy with the inspectors so the meals were not served on time. Moving forward, we will make sure to stick to the schedule even when visitors are here.

Description: Based on observation and staff interview, the family day home did not ensure that children are not allowed to eat or drink while lying down.

Evidence:
1. Child #2 (age: 16 months) was observed drinking their bottle while lying down in their crib.
2. Staff A and Staff B confirmed that some children do go to their cribs and drink their milk.

Plan of Correction: Moving forward, children will drink their bottles in the bouncy chairs and then we will place them in their cribs for naptime.

Description: Based on observation and staff interview, the menu for the current one-week period did not meet the following requirements:

1. The menu for the current one-week period was not given to parents, or posted or placed in an area accessible to parents.
2. The menu for the current one-week period did not list any substituted food. The menu for 1/23/2020 listed beef meatballs, spaghetti noodles, tomato sauce, and tangerines, but macaroni and cheese, beef meatballs, mixed vegetables, spaghetti sauce, and bananas was served. Substitutions were not documented on the menu.

Plan of Correction: The menu has been updated and posted for parents.

Description: Based on observation, the family day home did not ensure that infants and toddlers spend no more than 30 minutes of consecutive time during waking hours, with the exception of mealtimes, confined in a crib, play pen, high chair or other confining piece of equipment.

Evidence: Child #4 (11 months old) was observed in a bouncy chair from approximately 12:20pm to 1:23pm.

Plan of Correction: Child was removed upon direction from inspector.

Evidence:
1. Staff B did not wash their hands in between changing Child #6 and Child #7's diapers.
2. Staff A did not was their hands in between wiping a child's nose and then warming a child's food in the microwave.

Evidence: Staff B did not wash Child #6's (age:15 months old) and Child #7's (age:16 months old) hands after completing their diaper changes.

Description: Based on observation, the family day home did not ensure that the diapering surface met all requirements.

Evidence:
1. Staff B cleaned, but did not sanitize the diaper changing table in between diaper changes.
2. After changing a child's soiled diaper, Staff B left the soiled diaper on the diaper changing table while changing a second child's diaper.

Plan of Correction: All staff have reviewed rules for cleaning and sanitizing the diaper changing table.

Description: Based on record review, the family day home did not ensure that an employee was not employed until the home had the person's completed sworn statement or affirmation.

Evidence: Staff B's (date of hire: 1/6/2020) record did not have a completed sworn statement or affirmation.

Plan of Correction: Sworn disclosure has been placed in employee's file.

Description: Based on record review, 1 of 3 caregivers did not have a fingerprint check prior to the first day of employment.

Evidence: Staff B's (date of hire: 1/6/2020) record did not contain fingerprint results.

Plan of Correction: Employee has completed fingerprint results and they have been placed in the file.
