Comments:
A complaint investigation was initiated on 2/12/2020 and ended on 3/24/2020 regarding unsafe items on the children's playground. Observations and interviews were conducted, records were reviewed. There was a preponderance of evidence to support the allegation regarding hazardous items and the complaint was deemed valid. The complaint related violation and additional violations are identified in the Violation Notice.

Complaint related: Yes
Description: Based on observation, the center did not ensure that areas and equipment of the center were maintained in a clean, safe, and operable condition.

Evidence:
1. On 2/12/2020, approximately 9 loose bricks were found outside on the children's playground in the sandbox area under the pavilion.
2. On 2/12/2020, approximately 7 loose wooden slices were found scattered in various areas throughout the children's outdoor playground.
3. On 1/9/2020, Child #1 (age: 4 years old) threw a brick at another child's head. Staff A and Staff B verified that the unsafe conditions of loose bricks on the playground existed from approximately 1/6/2020 until approximately 2/12/2020, while the 42 children enrolled in the licensed programs continued to utilize the playground.

Plan of Correction: (Please note that the bricks were not in a sandbox area. The bricks were part of an oven the grade children had made and which had been vandalized. The bricks should not have been loose.) During our period of closure due to COVID-19, staff will be re-writing the Playground Safety and Rules section of our Emergency plan. Currently, all teachers share responsibility of monitoring the state of the equipment and the general environment of the playground. Going forward, there will be one individual in charge of monitoring the condition of the playground and taking immediate action to ensure it is maintained in a clean, safe, and operable condition.
