A complaint inspection was initiated on May 11, 2023 in response to a complaint that was received by the department on May 10, 2023, regarding the allegations of having too many children in the home. Only 4 children area allowed for an unlicensed day home or a voluntarily registered day home at any given time. Staff were interviewed, documentation was reviewed, observations were conducted, and a tour of the home was completed. The evidence gathered during the investigation confirms the allegations and determined to be a valid complaint with regards to having over the capacity of children in the home. A follow up visit was completed on June 26, 2023. The information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the program. The violations were discussed with the provider at the exit interview.

Standard #: 8VAC20-850-100-A Complaint related: No Description: Based on observation and interview, it was determined that the provider failed to ensure that the total number of children receiving care at any one time does not exceed four, which is the maximum capacity allowed by law for family day homes that may apply for voluntary registration.
Evidence:
1. Licensing inspectors observed a total of 11 children in the home.
a. Provider is registered to have a total of 4 children in care at any given time per their voluntary registered agreement.
2. USDA field monitor with The Planning Council of Norfolk, VA observed 11 children in the home on May 8, 2023 and provider was caring for all 11 of these children.
3. Vendor confirmed that they are watching over 4 children in their home.Plan of Correction: The provider responded with the following: The provider has agreed to reduce down. She is not longer helping with the additional children in the morning and afternoon as school is out for the summer and she will not be watching additional children. She agreed to keep it to 4 children in her care.
