Comments:
This inspection was conducted by the inspector using an alternate remote protocol necessary due to a state of emergency declared by the Governor of Virginia in response to the COVID-19 pandemic. The department received a complaint regarding allegations with supervision, and a subsequent investigation was initiated on September 15, 2020 and concluded on September 25, 2020. The inspector contacted the vendor by telephone to conduct the investigation. The inspector gave the vendor a list of documentation required to complete the investigation, interviewed additional staff and reviewed pictures provided by the vendor.
The evidence gathered during the investigation supported the allegation of non-compliance with standards or law, and violations were issued. Any other violations not related to the complaint but identified during the course of the investigation can also be found on the violation notice.

Violations:
Standard #: 22VAC40-665-550-2
Description: The vendor did not inform the department's representative as soon as practicable, but not more than two business days, of any injury to a child while under the vendor's supervision when a referral is made for treatment from a medical professional.

Evidence: While under the vendor's supervision on September 4, 2020, Child #1 (14 months old) sustained an injury that required treatment from a medical professional. The vendor did not inform the department's representative of the injury or that the child had to obtain treatment from a medical professional.

Plan of Correction: Vendor will follow through on reporting any injury that requires medical treatment moving forward.

Standard #: 22VAC40-665-610-A
Description: Based on staff interviews and a review of a picture as evidence, the vendor did not ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe, and operable condition. Unsafe conditions shall include splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting, or breakage of any equipment; head entrapment hazards; protruding nails, bolts, or other components that entangle clothing or skin; and unstable heavy equipment, furniture, or other items that a child could pull down on himself.

Evidence: According to staff interviews and a review of center documentation, Child #1 was playing and running in the classroom on September 4, 2020 and obtained an injury. The written injury report indicated and staff verified that the child tripped and hit his head on the leg of the chair. A picture sent by the facility showed that metal portions of the chair, including the legs, had multiple areas of rust and chipped and peeling paint.

Plan of Correction: The chair was discarded. Vendor will take inventory of the building to ensure that all equipment is in good repair.

Standard #: 22VAC40-665-700-C
Description: Based on review, the vendor did not ensure to maintain a written record of a child's injury with all required information documented.

Evidence: An injury report completed on 9/4/2020 did not include documentation of the time that the parents were notified of the injury.

Plan of Correction: The vendor will update the form to include the time.
