This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a in-person tour of the program A renewal inspection was initiated on 3/14/22 and concluded on 3/15/22. The provider was contacted by telephone to initiate the inspection. There were 35 children present and 10 staff. The inspector emailed the director/provider a list of items required to complete the inspection. The Inspector reviewed 5 children?s records and 5 staff records, along with any requested program records submitted by the facility to determine if required documentation was complete. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-260-B Description: Based on a review of documentation and interview, it was determined that the facility did not ensure that an annual approval from the local health department was completed.
Evidence:
1. The most recent health inspection report inspection available for viewing during the inspection was dated 1/5/21.
2. Staff #5 (Program Director) confirmed that the annual health inspection had not been completed.Plan of Correction: The facility responded: We have contacted the health department and are awaiting an inspection. We will forward the results to the Licensing Inspector.
Standard #: 8VAC20-780-330-B Description: Based on observation, it was determined that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99 and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles.
Evidence:
1. The resilient surface (mulch) around both play structures was less than the required 6 inches in depth
2. There were exposed tree roots at the base of the slide on the smaller play structure.
3. Staff #5 (Program Director) viewed the resilient surfacing (mulch) in the fall zone for the play structure, and confirmed that it was not compliant with the requirements in the standards of six inches of resilient surfacing.Plan of Correction: The facility responded: We will purchase additional mulch in order ensure that it is at least six inches deep in the fall zone for the play structure.
