63.2(17) License & Registration Procedures

Comments:
An unannounced renewal inspection was completed on 2/21/2020. There were 44 children present with eight staff supervising and two additional staff present (cook and site administrator). Five children's records were reviewed and five medications were reviewed. Seven staff records were previously reviewed on 2/11/2020.

The inspector arrived at the center at 9:10 am and departed at 1:00 pm.

The children were observed during arrivals, during free times in the classrooms, during breakfast, during structured activities, during story times, during lunch, and during nap.

Violations:
Standard #: 22VAC40-185-160-A
Description: Based on record review and interview, the center failed to ensure that each staff member submitted documentation of a negative tuberculosis (TB) screening or test within 21 days after employment.

Evidence:
1. Staff #7 had a documented hire date of 1/29/2020. There was no documentation of a TB test or screening for staff #7. Staff #7 was asked if a TB test or screening had been completed and stated that one had not been done.

Plan of Correction: Staff #7 will complete a TB test or screening and submit documentation.

Standard #: 22VAC40-191-60-B
Description: Based on record review and interview, the center failed to ensure that a person who was permitted to serve as an independent contractor and who was alone with, in control of, and supervising children had completed a "Sworn Statement or Affirmation" form as a part of the background check.

Evidence:
1. An independent contractor (IC) was observed to be alone with a child in a hallway by the adult bathrooms at arrival of the inspector. Subsequently, the independent contractor was observed to be alone with, in control of and supervising two additional children individually and alone during the inspection. All of the children were four years old. According to staff, the IC has been working with children since the beginning of the school year but typically works with the children in the classrooms where staff are present and supervising the child. The IC was alone with each child for a period of approximately five minutes. The center did not have any documentation of a "Sworn Statement or Affirmation" form as a part of the background check for this IC.

Plan of Correction: The IC will stay in the classroom while working with the children or the parents will be asked to give permission in writing to authorize the IC to work with the children alone.

Standard #: 22VAC40-191-60-C-2
Description: Based on record review and interview, the center failed to ensure that a person who was permitted to serve as an independent contractor and who was alone with, in control of, and supervising children had a completed "Search of the Central Registry" form from DSS as a part of the background check.

Evidence:
1. An independent contractor (IC) was observed to be alone with a child in a hallway by the adult bathrooms at arrival of the inspector. Subsequently, the independent contractor was observed to be alone with, in control of and supervising two additional children individually and alone during the inspection. All of the children were four years old. According to staff, the IC has been working with children since the beginning of the school year but typically works with the children in the classrooms where staff are present and supervising the child. The IC was alone with each child for a period of approximately five minutes. The center did not have any documentation of a completed DSSsearch of the central registry for this IC.

Plan of Correction: The IC will stay in the classroom while working with the children or the parents will be asked to give permission in writing to authorize the IC to work with the children alone.

Description: Based on record review and interview, the center failed to ensure that a person who was permitted to serve as an independent contractor and who was alone with, in control of, and supervising children had submitted to a fingerprint screening as a part of the background check.

Evidence:
1. An independent contractor (IC) was observed to be alone with a child in a hallway by the adult bathrooms at arrival of the inspector. Subsequently, the independent contractor was observed to be alone with, in control of and supervising two additional children individually and alone during the inspection. All of the children were four years old. According to staff, the IC has been working with children since the beginning of the school year but typically works with the children in the classrooms where staff are present and supervising the child. The IC was alone with each child for a period of approximately five minutes. The center did not have any documentation of a fingerprint record for this IC.

Plan of Correction: The IC will stay in the classroom while working with the children or the parents will be asked to give permission in writing to authorize the IC to work with the children alone.
