This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
An "other" inspection was initiated on March 1, 2021 and concluded on march 1, 2021 in response to a modification request for facility change of location that was received by the department on December 28, 2020. The director was contacted by telephone to initiate the inspection. There were 24 children present and five staff. The inspector emailed the director a list of items required to complete the inspection.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Standard #: 22VAC40-185-40-E Description: Based on interview, the facility did not ensure the center's activities, services, and facilities were maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence:
1. The License is issued for the facility located at 2605 Dumbarton Road, Henrico County.
2. The facility submitted a request for a change of location on 12/28/2020.
3. The administrator stated the center opened and accepted children in care on January 5, 2021.
4. The license modification to change the location had not been completed prior to the opening of the new location.Plan of Correction: Per the administrator: I Believed that once required items were installed and obtained we could open to our families.
Standard #: 22VAC40-185-330-B Description: Based on observation and measurements submitted by the facility remotely, the facility did not ensure fall zones were free of hazardous obstacles underneath and surrounding equipment and encompassed sufficient area to include the child's trajectory in the event of a fall while the equipment is in use. A fall zone shall not include barriers for resilient surfacing.
Evidence:
The main beam of the swing was approximately seven feet high requiring a fall zone of 14 feet to the front and rear of the swing. A fence was located within the fall zone at eleven feet from the front of the swing. A retaining boarder was within the fall zone at the rear of the swing at nine feet.Plan of Correction: Per the administrator: The swing will not be used until the required fall zones can be ensured.
