Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A code compliance inspection was initiated on February 18, 2021 and concluded on February 19,2021. The in-charge person was contacted by telephone to initiate the inspection. There were 20 children present and 6 staff. The inspector emailed the in-charge person a list of items required to complete the inspection. The Inspector reviewed 3 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on a record review and staff interviews, the licensee did not obtained for all employee who are expected to be alone with one or more children enrolled in the religious exempt child day center a sworn statement /affirmation before employment and a search of central registry (CPS) within 30 days of employment.

Evidence: The record for staff #2, date of hire 11-18-2020 did not include documentation of obtaining results of a CPS check. The CPS check is required to be submitted by the 30th day of employment. Staff #2 was confirmed working during the inspection by the designated person in charge.

Plan of Correction: Staff #2 has a background check on file with our church. We realize this is not the required form and have submitted a CPS check.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and staff interviews, the licensee did not obtained a copy of the results of a criminal records check (finger print check) prior to the first day of employment.

Evidence: The finger print checks available for review were dated after the first day of employment for the following staff;
1) Staff #1, date of hire 6-17-2020 and finger print check was dated 7-13-2020
2) Staff #3, date of hire 9-8-2020 and finger print check was dated 12-21-2020
Staff #1 and #3 were confirmed working during the inspection by the designated person in charge.

Plan of Correction: We have refined our system for new hires to obtain fingerprint checks before they begin work. Staff #1 and #3 had fingerprints return with no issues.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and staff interviews, the licensee did not obtained a copy of the results of a search of the central registry/child protective services check (CPS) and sex offender registry maintained by any other state in which the individual has resided in the preceding five years.

Evidence: The record for staff #3, date of hire 9-8-2020 did not include a CPS check or sex offender check for the state for New York and it did not include a CPS check for the state for Texas. Staff #3 had lived in New York and Texas within the last 5 years. The criminal records check and sex offender registry are required to be obtained prior to the first day or employment and the CPS check is required to be submitted by the 30th day of employment. Staff #3 was confirmed working during the inspection by the designated person in charge.

Plan of Correction: We have worked with our DSS representative to familiarize ourselves with out of state checks moving foreword, employees will not start until this has been obtained.
