Income Withholding Requirement

Under Virginia law (§ 20-79.3), which outlines the information included in an income deduction order, employers must honor an Income Withholding Order for Support (IWO) or other official notice for child support, such as a notice to start, change or stop withholding.

An Income Withholding Order for Support (IWO) is a court or administratively ordered deduction that tells an employer to take a set amount of money from a parent’s paycheck to pay child support. 

  • Employers must withhold the amount listed and send payments as instructed. Employers cannot change, delay, or stop withholding on their own.
  • Payments must be sent to the Division of Child Support Enforcement (DCSE) on each payday, or within four days if sent by computer transfer.
  • Employers with 100 or more workers and paycheck companies with 50 or more clients must send payments by computer transfer.
  • If there are questions about an order, the employer must contact the agency listed on the notice.
