Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on 12/1/2020 and concluded on 12/9/2020. A complaint was received by the department regarding allegations in the areas of staffing, management and resident funds, and maintenance of buildings and grounds. The Administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the Administrator a list of documentation required to complete the investigation.
The evidence gathered during the investigation supported the allegations of non-compliance with standards or law, and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-73-40-B
Complaint related: No
Description: Based on record review and interview, the facility failed to obtain the criminal history record report on or prior to the 30th day of employment for each employee.
Evidence: 1. Staff #1?s date of hire is 7/11/2020 and the criminal history report is dated 10/11/18.
2. Staff # 2?s date of hire is 9/5/2020 and the facility did not complete the criminal history record report.
3. Staff #3 acknowledged that the facility did not complete a history record on or prior to the 30th day of employment for Staff #1; and did not obtain a criminal history record for Staff #2.

Plan of Correction: Staff #1 transferred from a DSS facility on July 11, 2020. All records followed. All employees will have a current criminal history on record within 30 days.
Responsibility: Assistant Admin.

Complaint related: No
Description: Based on record review and interview, the facility failed to note any absences, substitutions, or other changes on the written work schedule.
Evidence: 1.The staff schedule dated October 2020 did not include any absences, substitutions, or other changes noted on the schedule.
2. Staff #3 stated ?I did not know where the working staff schedule for October is and I only have the October staff schedule that I made.?
3. Staff #3 acknowledged that the October 2020 staff schedule did not include any absences, substitutions, or other changes noted on the schedule.
Based on record review and interview, the facility failed to maintain a copy of the schedule for two years.
Evidence:
1. Staff #3 was asked to provide a copy of the staff schedule for November 2020; however, it was not provided.
2. Staff #3 acknowledged that the facility did not have a copy of the November 2020 staff schedule.

Plan of Correction: 1. All changes will be indicated on each monthly staff schedule.
2. All original staff schedules will continue to be available for two years without changes.

Description: Based on record review and interview, the facility failed to ensure all buildings shall be kept free of infestations of insects and vermin.
Evidence:
1. Report and invoice from ABC Pest Management, LLC dated 7/14/2020 documented ?do cleanout on kitchen area, use baits and baseboard application, pay particular attention to crack and crevice areas.?
2. Report and invoice from ABC Pest Management, LLC dated 7/28/2020 documented ?reservice kitchen area for roaches, rebait and treat cracks and crevices.?
3. Report and invoice from ABC Pest Management, LLC dated 9/14/2020 documented ?treat kitchen, bath, common areas, baseboards, also check glue boards in refrigerator room and middle kitchen/prep room behind hot water heater, check mice stations in kitchen, also check all mattresses for bedbugs. A special notation was also included requesting a proposal for German roaches.?
4. Report and invoice from ABC Pest Management, LLC dated 12/2/2020 documented ?treat entire kitchen areas thoroughly, having extreme roach problem, take vacuum, gel bait and flushing agent.
5. Staff #3 acknowledged that the facility has been treated since July 2020 to December 2020 by ABC Pest Management, LLC for mice, bedbugs, and German roaches.

Plan of Correction: Contract will continue to be renewed yearly, on due date, with ABC Pest Management, LLC. Treatments will be made in all areas as needed. ABC Pest Management will continue to be called when a bug is seen by staff between visits by pest company.
