Comments:
On 9/19/2019 one inspector conducted a complaint investigation (10:40am to 4:40pm - some other inspections were done during this time frame, also). One resident record and financial documents were reviewed. A staff person was interviewed. The complaint involved an improper discharge of a resident, and the evidence shows the discharge notice was not complete, so the complaint is valid.

During the inspection and at the exit interview, the facility was given the opportunity to discuss the violations and to show that they were in compliance. Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to your licensing inspector within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain the following: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Description: Based on document review and interview, the facility failed to specify the reason for the discharge on the discharge notice.

EVIDENCE:

1. The discharge notice for resident 1, dated 8/9/2019, states that the resident is being discharged because the facility is unable to meet the residents needs, but does not specify in the notice which needs cannot be met. Interview with staff 1 reveals that the reason for the discharge is non-payment of the monthly bill.

Resident 1 was admitted on 6/6/2019. On 9/6/2019 a partial payment was received by the facility, and resident 1 has been permitted to stay while other financial arrangements are made, or the resident moves to another facility.

Plan of Correction: North Roanoke Assisted Living will comply with the Standard 22 VAC 40-73-(5)-430-B. As mentioned in the description of the violation the cause of this violation is due to not specifying the reason on the discharge notice. Additionally, during this compliant investigation the LI was provided with several email correspondences between the HBH community service board representative, JFS resident?s legal guardian and the administrator regarding payment for services. The LI noted that the resident was admitted to the facility on 6/6/2019 and not until on 9/6/19 was a partial payment received. Therefore, the facility elected to give an eviction notice which was provided to the JFS resident?s legal guardian and HBH community service board representative on August 9, 2019. PLEASE NOTE that the facility continued to provide the resident with adequate services throughout his entire stay before partial payment until his discharge on October 1, 2019. Though, all parties which included the community service board representative from HBH, resident?s legal guardian from JFS and administrator were all aware of non-payment issues as well as the reason for the discharge notice. However, the facility received an violation and for these reasons the facility does not agree with this violation due to this is a technical matter. North Roanoke Assisted Living believes it should?ve received technical assistance instead of a violation. This plan of correction is submitted as required under State and Federal law. The submission of this Plan of Correction does not constitute an admission on the part of North Roanoke Assisted Living as to the accuracy of the surveyor?s findings or the conclusions drawn therefrom. Submission of this Plan of Correction also does not constitute an admission that the findings constitute a deficiency or that the scope and severity regarding the deficiency cited are correctly applied. Any changes to the North Roanoke Assisted Living?s policies and procedures should be considered subsequent remedial measures as that concept is employed in Rule 407 of the Federal Rules of Evidence and any corresponding state rules of civil procedure and should be inadmissible in any proceeding on that basis. North Roanoke Assisted Living submits this plan of correction with the intention that it be inadmissible by any third party in any civil or criminal action against North Roanoke Assisted Living or any employee, agent, officer, director, attorney, or shareholder of North Roanoke Assisted Living.
