Comments:
On 9/19/2019 a complaint investigation was begun regarding inadequate food at the facility. The investigation continued on 10/1/2019 and concluded on 10/22/2019 (off site). Based on the evidence, the complaint is valid.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to your licensing inspector within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain the following: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Description: Based on interviews, the facility is not serving well-balanced meals.

EVIDENCE:

1. A resident stated that there is not always sufficient food for everyone and menus are not always followed.

2. A worker from an outside agency stated that on 8/26/2019 the residents on unit 4 were served only pre-packaged peanut butter and jelly uncrustable sandwiches and a beverage - either lemonade or tea.

The lunch menu for 8/26/2019 (North Roanoke Menu Week One Spring & Summer) shows the lunch that day should have been turkey and cheese sandwich L/T [lettuce/tomato], potato chips, fruit, and tea or milk.

3. A worker from an outside agency stated that on 8/27/2019 the residents on unit 4 were served only sandwiches and a beverage.

The lunch menu for 8/27/2019 (North Roanoke Menu Week One Spring & Summer) shows the lunch that day should have been egg salad sandwich, Sun Chips, fruit, and tea or milk.

Plan of Correction: North Roanoke Assisted Living will comply with the Standard 22 VAC 40-73-(6)-590-A. NRAL does not agree with this violation. Additionally, on July 17th the facility received an unannounced licensing visit regarding a complaint on food. The LI met with the Dietary Manager and toured the kitchen which included the freezers and other food storage rooms. This complaint was not founded per the LI on the day of this unannounced licensing visit. On July 24th the facility received an unannounced licensing visit for the annual renewal. During this annual renewal visited the dietary department was inspected as well. Please note that this was the second visit within the last 7 days. On this annual renewal visit the facility received a violation in the dietary department. However, it was not related to food but documentation. The facility was cited for not having the dates listed on the menu but the day of the week was listed. Again on the September 19th the facility received another visit in reference to another food complaint which resulted in a continuation of this visit into a second visit for this particular complaint on October 1st. This complaint was concluded on October 22nd. As the violation description mentions only one resident, one worker and one outside agency worker were interviewed. All of which are listed as anonymous. Nevertheless, the facility has ensured and will continue to ensure that all residents receive the adequate nutrition and offered seconds as it relates to the facility house diet which is approved by the resident?s medical doctor as well as dietician. Additionally, the facility also frequently offers thirds, fourths and fifths when available. If a resident is not satisfied with the main entree they are offered a substitute and the sides if the wish. However, very often the residents refuse the sides that are being served and settle for the sandwiches only. At no point are the residents in our care not provided/offered a well-balanced meal. Menus are subjected to change and changes are listed on the menu. In the case if a certain item that is being served has been depleted then the resident is offered a different item. Furthermore, for these reasons the facility does not agree with the risk rating for this violation. This plan of correction is submitted as required under State and Federal law. The submission of this Plan of Correction does not constitute an admission on the part of North Roanoke Assisted Living as to the accuracy of the surveyor?s findings or the conclusions drawn therefrom. Submission of this Plan of Correction also does not constitute an admission that the findings constitute a deficiency or that the scope and severity regarding the deficiency cited are correctly applied. Any changes to the North Roanoke Assisted Living?s policies and procedures should be considered subsequent remedial measures as that concept is employed in Rule 407 of the Federal Rules of Evidence and any corresponding state rules of civil procedure and should be inadmissible in any proceeding on that basis. North Roanoke Assisted Living submits this plan of correction with the intention that it be inadmissible by any third party in any civil or criminal action against North Roanoke Assisted Living or any employee, agent, officer, director, attorney, or shareholder of North Roanoke Assisted Living.
