Comments:
On 12/5/2019 one inspector conducted a complaint investigation alleging violence between a resident and a staff member. The inspector was unable to find a preponderance of evidence to support the allegation; the complaint is not valid.

During the inspection and at the exit interview, the facility was given the opportunity to discuss the violations and to show that they were in compliance. Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to your licensing inspector within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain the following: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Description: Based on observation, the facility failed to make records available to the department's representative (licensing inspector).

EVIDENCE:

1. The inspection began at 4PM and staff refused to give the inspector requested records.

Plan of Correction: North Roanoke Assisted Living will comply with the Standard 22 VAC 40-73-(6)-560-B. The licensing inspector stated that the facility failed to make records available to the department's representative (licensing inspector). However, this is an inaccurate and vague statement as evident the Facility's Licensee was contacted by the Administrator to provide the licensing inspector with the requested records due the Administrator was unavailable with an illness. Initially, when the licensing inspector arrived at the facility approximately around 4pm and requested the records from the designated person in charge the administrator was immediately contacted per the facility's protocol. The licensing inspector states that the designated person in charge refused to give her the requested records. This statement from the licensing inspector is not accurate. The designated person in charge contacted her Administrator and received instructions from the Administrator to wait on the Licensee. The Administrator informed the designated person in charge that the Licensee would be arriving shortly at the facility to speak with the licensing inspector regarding her visit and to provide her with the requested records. This information was relayed to the licensing inspector. Therefore, shortly after the Licensee arrived to the facility and spoke with the licensing inspector. The licensing inspector was provided with requested records by the Licensee therefore the statement of staff refusing to provide records is incorrect. The designated person in charge (North Roanoke Assisted Living employee) was following directives from her superior (Administrator of North Roanoke Assisted Living). Furthermore, the conduct of the licensing inspector was not very friendly as it was perceived that she was implying that her authority position with the Department of Social Services could have the employee terminated for not honoring her request however following directives from her Administrator.

This plan of correction is submitted as required under State and Federal law. The submission of this Plan of Correction does not constitute an admission of the part of North Roanoke Assisted Living as to the accuracy of the surveyor's findings of the conclusions drawn therefrom. Submission of the Plan of Correction also does not constitute an admission that the findings constitute a deficiency or that the scope and severity regarding the deficiency cited are correctly applied. Any changes to the North Roanoke Assisted Living's policies and procedures should be considered subsequent remedial measures as that concept is employed in Rule 407 of the Federal Rules of Evidence and any corresponding state rules of civil procedure and should be inadmissible in any proceeding on that basis. North Roanoke Assisted Living submits this plan of correction with the intention that it be inadmissible by any third party in any civil or criminal action against North Roanoke Assisted Living or any employee, agent, officer, director, attorney, or shareholder of North Roanoke Assisted Living.
