Comments:

A non-mandated complaint inspection was initiated on 10/05/2021 and concluded on 10/19/2021. A complaint was received by the department regarding allegations in the areas of staffing and resident care and related services. The Administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the Administrator a list of documentation required to complete the investigation. The evidence gathered during the investigation supported the allegations of non-compliance with standards or law, and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Description:	Based on document review and staff interview, the facility failed to implement their written plan that specifies the number and type of direct care staff required to meet the day-to-day, routine direct care needs and any identified special needs for the residents in care. EVIDENCE: 1. The facility?s written plan, provided by staff 1, that specifics the number and type of direct care staff required to meet the day-to-day, routine direct care needs and any identified special needs for the residents in care, showed that the facility will have 10 direct care staff from 7AM ? 3PM (first shift) and 3PM ? 11PM (second shift) Monday through Friday; 8 direct care staff from 7AM ? 3PM (first shift) and 3PM ? 11PM (second shift) on weekends and holidays and 4 direct care staff from 11PM ? 7AM (third shift) on Monday through Friday, weekends and holidays. 2. Staff assignment sheets and staff schedule provided by staff 1 has documentation for numerous days from 09/01/2021 through 10/04/2021 that the facility did not have the number of direct care staff working at all times that the written plan stated is needed on all three shifts.
Plan of Correction:	The Facility?s Written Plan specifying the number and type of direct care required to meet the day-to-day, routine direct care needs and any identified special needs for the residents in care has been updated. Administrator/Designee will ensure the plan is followed.
