Comments:

On 7/23/2019 one inspector conducted an investigation (11:10am to 3:45pm) of a self-reported incident involving two staff members restraining a resident without an allowed reason. One resident record was reviewed, staff schedules and staff files were reviewed, other facility documents were reviewed, and staff people were interviewed.

Standard #:	22VAC40-73-550-C
Description:	Based on interview and document review, the facility failed to provide a resident with the rights as provided in ? 63.2-1808 of the Code of Virginia. EVIDENCE: 1. Resident 1 was not free of physical restraint. The situation was not an emergency situation which threatened the immediate safety of the resident or others, and the resident did not have unmanageable behavior that would necessitate being restrained. The facility reported to licensing that two staff people were involved in holding a resident by the arms and causing bruising while providing a service of changing undergarments for resident 1. Staff 1 signed a document outlining their part in the incident. Another document on staff 2 gives a slightly different story, and this staff person did not sign the document.
