Subjectivity

Comments:
On 1/21/2020 one inspector conducted an investigation (2:30PM to 5:15PM) regarding an incident reported by the facility to licensing. One resident record and two staff records were reviewed. Violations noted during the investigation are cited in this violation notice.

Discussion: Although there were not violations found regarding training staff on dealing with residents who have dementia, it might be beneficial to the facility to accelerate the training for new staff who are assigned to the Memory Care unit.

During the inspection and at the exit interview, the facility was given the opportunity to discuss the violations and to show that they were in compliance. Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to your licensing inspector within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain the following: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Description: Based on resident record review, the facility failed to be assessed in accordance with Assessment in Assisted Living Facilities (22VAC30-110).

EVIDENCE:

1. The uniform assessment instrument (UAI) was not signed by the assessor, as required in Assessment in Assisted Living Facilities (22VAC30-110).

Standard #: 22VAC40-73-550-C
Description: Based on document review, the facility failed to ensure that staff honored resident rights as provided in ? 63.2-1808 of the Code of Virginia.

EVIDENCE:

1. The facility sent in an incident report that described resident 1 being held down by staff 1 to have Depends changed staff person 2, which resulted in bruises to the top of her hands. Resident 1 was not free from degrading or demeaning acts, and was not treated with courtesy, respect, and consideration as a person of worth, sensitivity, and dignity.

2. Review of records for staff 1 and 2 confirm their actions.
