Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 6/19/2020 and concluded on 6/29/2020. A complaint was received by the department regarding allegations in the areas of disclosure and residency agreement related to resident care. The administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the administrator a list of documentation required to complete the investigation.

The evidence gathered during the investigation did not support the allegation of non-compliance with standards or law. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Description: Based on record review, facility failed to ensure that the rights and responsibilities of residents shall also post the name and telephone number of the appropriate regional licensing supervisor of the department, the Adult Protective Services' toll-free telephone number, the toll-free telephone number of the Virginia Long-Term Care Ombudsman Program and any substate (i.e., local) ombudsman program serving the area, and the toll-free telephone number of the disAbility Law Center of Virginia.

Evidence: Residency agreements signed by legal representatives for Resident #1 on 8/09/2019 and by Resident #2 on 6/16/2020 included Resident Rights as Exhibit 5 and did not include the name and telephone number of the appropriate Regional Licensing Administrator of the Virginia Department of Social Services.

Plan of Correction: A. With respect to the specific resident/situation cited: The Executive Director has updated the name and phone number of the Regional Licensing Administrator on exhibit 5, Resident Rights.
B. With respect to how the facility will identify residents/situations with the potential for the identified concerns: The Executive Director will complete an audit of the Residency Agreement to confirm that names and phone numbers are accurate and current. If issues are identified they will be resolved.
C. With respect to what systemic measures have been put into place to address the stated concern: The Executive Director and Director of Sales will implement a process to review Residency Agreement templates prior to reviewing with Responsible Parties to confirm the name and phone number of the Regional Licensing Administrator is accurate.
D. With respect to how the plan of correction will be monitored: The Executive Director or designee is responsible for the implementation and continued adherence to the various steps outlined in this Plan of Correction. Additionally, the ED is responsible for addressing and resolving concerns that may arise related to the implementation and adherence.
