Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on 07/07/20 and concluded on 07/09/2020. A self-reported incident was received by the department regarding allegations in the areas of 22VAC40-73-550. The Administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the Administrator a list of documentation required to complete the investigation. The evidence gathered during the investigation supported the self-report of non-compliance with standards or law, and violations were issued.

Violations:
Standard #: 22VAC40-73-550-C
Description: Based on a review of facility documentation and interviews with staff, the facility failed to ensure resident rights were provided as per 63.2-1808 of the Code of Virginia and this chapter.

Evidence:

1. A facility report was received on 6/30/20 in regards to staff person 1 taking monies from resident 1 to purchase the resident gift cards to use for on-line purchases but not returning the monies in full back to the resident. The report also included information that resident 1 gave staff person 1 at least two necklaces. The facility investigation resulted in termination of staff person 1 on 7/1/2020 and the local law enforcement and APS were contacted. As staff person 1 was an employee of the facility, the facility failed to ensure resident 1's rights to be free from financial exploitation were provided.

Plan of Correction: Administrator consulted with APS staff and Ombudsman on 7/1/20 regarding appropriate trainings to provide for staff to ensure similar boundary and ethical issues do not recur. All Town Creek Staff were assigned Boundaries and Ethics Training for completion on 7/14/20, which includes a post-test to ensure competencies. Administrator met with all residents on 7/8/20 to provide training and education on appropriate boundaries and communication with staff around gifts, communication, money and expectations. Administrator will continue to monitor all staff and consult with Person in Charge, as well as communicate with residents regularly to ensure no similar instances occur.
