Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 7/27/2020 and concluded on 8/17/2020. A complaint was received by the department regarding allegations in the areas of meals and resident rights. The administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the administrator a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the allegation(s) of non-compliance with standards or law, and violations were issued. Any violations not related to the complaint(s) but identified during the course of the investigation can be found on the violation notice.

Description: 550-C

Based on document review and interview, the facility failed to ensure that the resident has the rights and responsibilities as provided in 63.2-1808 of the Code of Virginia, specifically that the resident is free from threats or other degrading or demeaning acts against him.

EVIDENCE:

1. Resident 1 stated that staff 1 comes around to resident rooms and reminds them of their upcoming meal times. Resident 1 stated that on the occasions that residents come in late for meals, staff 1 seems angry because of it and it makes them feel threatened.
2. Resident 1 stated that after voicing his concerns about staff 1 to others, staff 1 came to his room and threatened him saying, ?If you?ve got problems with me, you come to me about it and not everyone else?. Resident 1 also said that staff 1 said to him, ?I?ll beat your ass and I don?t care if I go back to jail?.
3. Resident 1 also stated that although some residents prefer to eat in their rooms, staff 1 has never withheld meals or forced him to eat in his room because was late to a meal.
4. Staff 2 stated that staff 1 was hired in 4/2019 and was reprimanded and counseled on 6/29/2020 and 7/27/2020 for the way that he communicates with residents, which was observed in the staff record.

Plan of Correction: Staff 1 will continue to participate with communication in-services and one on one counseling with administration.

Meal times will be monitored by administration to ensure the resident's rights.

Resident has appointment set for case management services including psychiatry.
