22VAC40-90 The Criminal History Record Report

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A renewal inspection was initiated on 10/26/2020 and concluded on 10/27/2020. The administrator was contacted by telephone to initiate the inspection. The administrator reported that the current census was 46. The inspector emailed the administrator a list of items required to complete the inspection. The inspector reviewed three resident files and three staff files along with facility schedule, background checks, health department inspection and fire inspection. These items were submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations were documented on the violation notice issued to the facility.
Please develop a plan of correction for the one violation cited along with a date of correction and return a signed and dated copy back to the licensing office within 10 calendar days (11/06/2020). Violations:
Standard #: 22VAC40-90-40-B
Description: Based on documentation and interview with staff, the facility has failed to obtain a criminal history record report on three employees within the 30th day of employment.
EVIDENCE:
1. Staff #1 was hired on 09/01/2020. The criminal history record report was not obtained until 10/23/2020.
2. Staff #2 was hired on 12/23/2019. The criminal history record report was not obtained until 02/03/2020.
3. Staff #3 was hired on 01/27/2020. The criminal history record report was not obtained until 09/24/2020.

Plan of Correction: Staff #1 criminal history record was obtained on 10/23/2020. Staff #2 criminal history record was obtained 12/23/2019. Staff #3 criminal history record was obtained by 01/27/2020. All were added to the appropriate files. Error has been corrected as of date of inspection. Executive Director or designee will review all new staff records prior to hire to ensure that all criminal history results are received. [sic]
