Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 12/4/2020 and concluded on 12./21/2020. A complaint was received by the department regarding allegations in the areas of discharge of residents. The administrator was contacted by telephone to conduct the investigation. The licensing inspector emailed the administrator a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the allegations of non-compliance with standards or law, and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Description: Based on documentation review and staff interviews, the facility failed to ensure that within 60 days of discharge each resident or his legal representative shall be given a final statement of account, any refunds due and return of any money, property, or things of value held in trust or custody by the facility.

EVIDENCE:
1. Resident # 1 was discharged from the facility on 01/23/2020 and was admitted to the hospital on 01/25/2020 on an emergency basis.
2. Resident # 1 was at the hospital from 01/25/2020 until 07/24/2020 when he was admitted to another residential living facility.
3. According to an interview with the accounting manager and the administrator along with documentation received from the facility, resident #1 's social security check continued to be directly deposited into the facility's account until November 2020.
4. The accounting personnel at the hospital stated she sent a statement to this facility with the amount owed for his stay at the hospital that insurance did not cover. No payments were ever forwarded to the hospital according to their records.
5. According to documentation sent by the facility and an interview with the accounting manager for the facility, a check was made out to the resident for a refund in the amount of $9,573.26 to be sent to the Social Security Administration on 09/30/2020. According to the social security administration stated they did not have a receipt number where the money has been returned. The facility administrator stated she had not received any paperwork from the social security administration with confirmation of the return which is standard procedure as of 12/21/2020. The check had not been placed in the mail back to Social Security. The accounting manager for the facility stated she has been in contact with social security to get this issue resolved.
5. The facility where the resident currently resides is now the payee for this resident and the social security check for resident # 1 is being received. The administrator at the current facility stated the resident is behind a considerable amount since they were able to take over as payee in October. This puts resident # 1 at risk for discharge if he is unable to pay for his care and services. He now has an outstanding balance at two facilities since January 25, 2020.

Plan of Correction: Resident or legal guardian will be given a formal statement of account and any refunds due and return of money, property, or things of value held in trust or custody within 60 days of discharge from the facility.

Accountant will notify administrator when funds are returned.

Administrator will monitor the return of funds/property. [sic]
