22VAC40-73 RESIDENT CARE AND RELATED SERVICES

Comments:

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitoring inspection was initiated on 1/12/2021 and concluded on 2/4/2021. A self-reported incident was received by the department regarding allegations in the areas of resident care and related services. The Administrator was contacted by telephone to conduct the investigation and documentation required to complete the investigation was requested. The evidence gathered during the investigation supported the non-compliance with standards or law, and violations were issued.

Violations:

Standard #:	22VAC40-73-550-C
Description:	Based on a review of facility documentation and staff interviews, the facility failed to ensure that resident rights and responsibilities were provided to residents. EVIDENCE: 1. On 1/7/2021 the facility administrator received employee written statements in regards to staff person 1 being verbally abusive to residents who reside in the memory care unit. Interviews with staff supported residents were not free from verbal abuse or neglect in regards to the verbal comments made to residents by staff person 1 and staff person 1 was terminated from employment on 1/12/2021.
Plan of Correction:	1.What was done to correct? Staff person #1 was immediately suspended pending investigation. Staff #1 was terminated on 1/12/2021 for verbal abuse. 2.How will this recurrence be prevented? Staff to be re-in serviced on resident rights & responsibilities and abuse. 3.Person responsible? Resident Care Director, Assistant Resident Care Director, Executive Director, and or designee.
