22VAC40-73 RESIDENT CARE AND RELATED SERVICES

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 3/18/2021 and concluded on 3/19/2021. The administrator was contacted by telephone to initiate the inspection. The administrator reported that the current census was 18. The inspector emailed the administrator a list of items required to complete the inspection. The inspector reviewed two resident records, two staff records, resident roster, staff roster, staff schedule, facility health care oversight, fire and emergency drills, and the health department inspection report submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law, and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-73-480-E
Description: 480-E

Based on record review, the facility failed to ensure that the evaluations of progress and other pertinent information regarding rehabilitative services shall be recorded in the resident?s record.

EVIDENCE:

1. The resident roster indicated that resident 2 was receiving physical therapy (PT) and occupational therapy (OT) services.
2. As requested, staff 3 provided copies of PT and OT progress notes; however, staff 3 indicated that the therapy progress notes had to be obtained from the therapy providers because copies were not kept in the resident?s record.

Plan of Correction: Administrator will obtain therapy notes for the resident and keep them up to date.

Description: 680-E

Based on record review, the facility failed to ensure that medical procedures or treatments ordered by a physician or other prescriber shall be provided according to his instructions are documented in the resident?s record.

EVIDENCE:

1. The record for resident 2 contained physician?s orders, dated 11/9/2020, for nightly oxygen therapy using an oxygen concentrator with a nasal cannula and a flow rate of two liters per minute; however, the record did not contain any documentation of oxygen use by the resident.
2. An interview with staff 3 indicated that resident 2 regularly refuses his oxygen therapy; therefore, the facility does not have a log which tracks his oxygen use.
3. Staff 3 also indicated that the primary care physician (PCP) for resident 2 has been made aware that he refuses to use his oxygen as ordered, and the PCP has urged the facility to continue offering oxygen therapy to the resident.

Plan of Correction: Administrator will contact PCP to clarify PRN orders for O2. Also, staff shall document O2 usage for resident.
