A legal representative of a resident shall be provided access to the resident's record or part of the record as allowed by the scope of his legal authority.
Evidence:
1. The legal representative of Resident #1 requested access to the resident?s record via email on 01/25/2023 and completed the Authorization for Release of Protected Health Information form as required by the facility?s procedure on 01/26/2023 to Staff #1.
Despite the written request to release the resident?s records and completion of the Authorization for Release of Protected Health Information form, as of 05/02/2023, the facility has not provided access to the resident?s record to the legal representative of the resident.Plan of Correction: Not available online.
