The Acknowledgement of Inspection form was signed and left at the facility for each date of the inspection.

A complaint was received by VDSS Division of Licensing on 7/20/2023 regarding allegations in the area(s) of:

Personnel

Number of residents present at the facility at the beginning of the inspection: 71
The licensing inspector completed a tour of the physical plant that included the building and grounds of the facility.

The evidence gathered during the investigation supported the allegation(s) of non-compliance with standard(s) or law, and violation(s) were issued. Any violation(s) not related to the complaint(s) but identified during the course of the investigation can also be found on the violation notice.

The licensee has the opportunity to submit a plan of correction to indicate how the cited violation(s) will be addressed in order to return the facility to compliance and maintain future compliance with applicable standard(s) or law.

If the licensee wishes to provide a plan of correction: (i) type the plan on a separate Word document, (ii) identify the standard violation number being addressed, (iii) include the date the violation will be corrected, (IV) do not include any names or confidential information, and (V) return to the licensing inspector by email within five (5) business days of the exit interview.
Compliance with all applicable regulations and law shall be maintained and any areas of noncompliance must be corrected.

Within 15 calendar days of your receipt of the inspection findings (inspection summary, violation notice, and supplemental information), you may request a review and discussion of these findings with the inspector's immediate supervisor. To make a request for review and discussion, you must contact the licensing supervisor at the regional licensing office that serves your geographical area.

Regardless of whether a supervisory review has been requested, the results of the inspection will be posted to the DSS public website within 5 business days of your receipt of the Inspection Summary and/ or Violation Notice.

The department's inspection findings are subject to public disclosure.

Complaint related: No
Description: Based on emails received at the department and interviews conducted, the facility failed to immediately notify the Virginia Board of LongTerm Care Administrators and or the regional licensing office that the licensed administrator resigned, was discharged, or became unable to perform his duties and that a new licensed administrator has been employed or that the facility is operating without an administrator licensed by the Virginia Board of Long-Term Administrators, whichever is the case, and provide the last date of employment of the previous licensed administrator.

Evidence:

1. The regional licensing office received an anonymous complaint by phone on 7/20/2023 stating the facility was operating without an administrator.

2. The Licensing Inspector conducted an onsite inspection on 7/21/2023 and was advised by staff member #5 that the facility did not currently have an administrator.

3. The Licensing Inspector contacted staff #4 who verified the dates of employment for the previous acting administrator as 6/19/2023 through 7/19/2023.


4. The Licensing Inspector verified the facility had not contacted the Virginia Board of Long-Term Care to provide notification that the facility?s licensed administrator had resigned or was discharged.

5. A 7/25/2023 email from staff #3 verified the facility did not have an administrator or an acting administrator.

Plan of Correction: 1. There is an acting administrator as of 8/21/2023.

Complaint related: No
Description: Based on observation, the facility failed to ensure the posting of the name of the current on-site person in charge.

Evidence:

1. On the date of the inspection, there was no posting on the on-site person in charge.

2. Staff members #1 and #4 both acknowledged there was no posting.

Plan of Correction: 1. A daily on-site person in charge form was created and posted at the front desk daily.

2. An in-service will be completed with staff to ensure compliance with 22VAC40-73290-B.

3. The Executive Director will monitor for compliance.
