22VAC40-185 STAFFING AND SUPERVISION.
An complaint inspection was initiated on May 3, 2018, regarding staff to children ratio requirements. The inspection included observations, a review of center documentation and interviews with staff members. Based on information obtained during the inspection the preponderance of evidence does support the allegation related to staff to children ratio requirements therefore the complaint is determined to be VALID. Areas of non compliance are noted on the violation notice.
Standard #: 22VAC40-185-350-E-5 Complaint related: No Description: Based on record review and staff interviews, the licensee did not ensure child ratio was maintained for the children, from age of eligibility to attend public school through eight years, one staff member for every 18 children. Evidence: The head count sheets maintained by the center for the before and after school program revealed that the center did not meet the required staff-to-children ratio on the following dates: 1- April 9, 2018, from 3:29pm to 4:29pm; two staff with 43 children 2- April 10, 2018, from 3:33pm to 4:37pm; two staff with 40 children 3- April 11, 2018 From 7:50 am to 8:30 am; two staff with 38 children From 3:33 pm to 4:40 pm; two staff with 45 children 4- April 18, 2018, from 3:32 pm to 4:38 pm; two staff with 41 children 5- April 24, 2018 From 7:52 am to 8:30 am; two staff with 38 children From 3:32 pm to 3:46 pm; two staff with 39 children 6- April 25, 2018, from 3:29 pm to 4:59 pm; two staff with 38 children 7- April 26, 2018, from 7:51 am to 8:30 am; two staff with 41 children 8-April 27, 2018, from 7:51 am to 8:30 am; two staff with 38 children Staff members confirmed there were multiple dates that the center did not comply with required staff-to-children ratios during the month of April 2018 on the above listed dates. Plan of Correction: -An additional site teacher has already been hired & trained in order to maintain ratio. -Contracted schedules are reviewed daily to ensure we are staffed to enrollment numbers. -Subs will be used when necessary due to emergencies.
