The following TA was provided:...an exception to the standard (280.B.) that all cleaning supplies and hazardous materials must be locked when not in use. An example of adherence to 280.B is when a table used for meals is being cleaned and the cleaning items are taken out of the locked area, used, and then returned to the locked area once the table is clean. This exception was created specifically to address issues when a similar procedure was applied to diapering. Because of the exception, there are times when cleaning supplies used in diapering do not have to be locked away when not in use. If there are only infants in the room and diapering occurs many times throughout the day and the cleaning supplies are out of the reach of children, then the facility is in compliance. If toddlers are present, then their ability to access the cleaning supplies must be taken into consideration when determining compliance. If diapering only occurs during certain designated time frames (e.g., 10:00 to 10:15), then the cleaning supplies should only be unlocked during those same time frames and locked away all other times.
The licensing inspector conducted an unannounced renewal inspection on Thursday, July 26, 2018 from 10:00am to 1:20pm to determine the center's compliance with licensing standards. During this inspection, the center's director was present and assisted the licensing inspector throughout this inspection. The census for today's inspection consisted of 60 children in care and eleven staff. During the inspection, the licensing inspector observed the children playing with toys, reading books, and doing crafts. The children were also observed playing outside and during water play. The following information was reviewed: program activities, supervision, staffing, interactions with children, daily routines, menu, posted information, emergency supplies and drill records, and agency inspection reports. The last documented health inspection occurred July 11, 2018. The last documented fire inspection occurred May 23, 2018. There were six children's records and six staff's records reviewed during this inspection. The center's first aid kit and emergency supplies were inspected. The provider must send documentation to the licensing inspector that the request for out-of-state complaints of child abuse have been requested no later than 10 days following this notification dated July 27, 2018. Standard #: 22VAC40-185-140-A Description: Based on a review of six children's records on 07/26/2018, the center did not ensure one child obtained documentation of a physical examination by or under the direction of a physician prior to attendance or within 30 days of attendance. EVIDENCE: 1) There was only an immunization record in the file for Child #4. 2) The record for Child #4 (DOA: 03/20/2017)contained a Health Information Form signed by a parent, but the Physical Examination Report portion was not completed nor signed by a physician or designee. Plan of Correction: The center has notified the parents to submit a physical examination report. The center will retrain staff on ensuring proper physical examination documentation is on file for children's records.
Standard #: 22VAC40-185-280-B Description: Based on observation on 07/26/2018, the center did not ensure that potentially hazardous substances, such as, but not limited to, cleaning materials, were kept in a locked placed using a safe locking method that prevents access by children.
EVIDENCE: 1) Cleaning supplies and disinfectant spray were observed on an unlocked shelf in the toddler room. No children were in the classroom and the cleaning materials were not in use. Hazardous substances shall be kept in a locked place that prevents access by children.
Plan of Correction: The center will install floating shelves in the classroom with a lock box by the end of the month.
Standard #: 63.2-1720.1-B-3 Description: Based on a review of six staff records on 07/26/2018, the center did not request a search of out-of-state founded complaints of child abuse for one staff member who has lived outside of Virginia within the last five years. EVIDENCE: During the inspection, the Sworn Statement for Staff #2 indicated the staff member had lived outside of Virginia within the last five years. The records did not contain documentation of a requested founded complaint of child abuse from the state the staff member indicated she had lived in within the last five years. Staff #2 was an existing employee at the center when the Code of Virginia changed, effective 07/01/2017, requiring out of state central registry searches. The out of state request should have been submitted by the facility no later than 09/01/2017. Plan of Correction: The center will request the out-of-state check today.
