22VAC40-191 Background Checks (22VAC40-191)
An unannounced focused inspection was conducted on September 5, 2018. Upon arrival to the center, there were 14 children with four staff members. The licensing inspector focused on administration, background checks, physical plant and special care provisions and emergencies. Seven staff records were reviewed. Areas of noncompliance are identified on the Violation Notice. The exit interview was conducted with the Interim Program Director.
Standard #: 22VAC40-185-160-A Description: Based on record review, in one of seven staff records reviewed, the licensee did not ensure that each staff member shall submit documentation of a negative tuberculosis screening. Documentation of the screening shall be submitted no later than 21 days after employment and shall have been completed within 12 months prior to or 21 days after employing. Evidence: During the inspection conducted on September 5, 2018, there was no documentation of a TB screening in the record for Staff #2 (date of hire 2/27/18). Plan of Correction: Program Director will request that the staff member get a TB screening.
Standard #: 22VAC40-185-70-A Description: Based on record review, in three of seven staff records reviewed, the licensee did not ensure that each staff record was documented with all required information. Evidence: During the inspection conducted on September 5, 2018, the following information had not been documented in each staff person's record: Staff #2 (date of hire 2/27/18)-there was no documentation that orientation training had been completed, there was not an address of one person to contact in the event of an emergency and there was no documentation that two or more references were checked prior to employment Staff #4 date of hire 3/23/18)-there was no documentation that orientation training had been completed Staff #5 (date of hire 12/5/17)-there was no documentation that two or more references were checked prior to employment Plan of Correction: Program Director will contact HR to see what paperwork they already have for Staff #2. I will have the staff member to update the emergency contact information. The orientation paperwork was signed for Staff #4 during the inspection. Reference letters will be requested for Staff #5.
Standard #: 22VAC40-185-270-A Description: Based on observation and inspection of the facility, the licensee did not ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to breakage of any equipment. Evidence: During the inspection conducted on September 5, 2018, as observed by the inspector and reported by the Program Director, the air conditioning unit for the facility was not operable and the internal temperature of the building measured at approximately 86.4 degrees. Plan of Correction: A maintenance person came in today and checked the units. We purchased a portable unit to be used.
