The local agency representative and licensing inspector conducted an unannounced inspection in response to a complaint that was received by the licensing department on August 7, 2018 regarding supervision. The inspection was initiated on August 9, 2018 and completed on September 18, 2018. During the inspection, interviews were conducted with the staff, observations of physical plant and transportation, a review of child's and staff's records, center's video footage, and all pertinent documentation were reviewed. The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. Standard #: 22VAC40-185-240-B Complaint related: Yes Description: Based on review of staff handbook, the center did not ensure all staff received written required information pertaining to procedures for identifying where attending children are at all times, including procedures to ensure that all children are accounted for before leaving a field trip site and upon return to the center. Evidence: A review of the center's staff handbook did not include written center's procedures for accounting for all children before leaving a field trip site and upon return to the center. Plan of Correction: The center will ensure that all children will have name tags with information of the building and contacts numbers. The children will also have Creative Kids t-shirt and staff will have walkie talkies. All staff has received training to include procedures from exiting the building, loading on the van, headcounts, and returning to the building.
Standard #: 22VAC40-185-340-A Complaint related: No Description: Based on interviews with staff and review of documentation, the center did not ensure staff always demonstrated care and protection when supervising children. Evidence: 1. During the inspection conducted on August 9, 2018, interviews with the staff confirmed a four year old child was left unaccompanied at a local movie theater while on a field trip with sixteen children and three staff. The interviews with Staff#1, Staff#2, Staff#3 revealed there were three head counts; conducted prior to leaving the center, arrival to the theater, and after the movie inside the theater with the children were lined up on the wall. Staff#1 reported Child#1 was known as a "wanderer" and conveyed staff's reservation about participation during this field trip. Staff#1, Staff#2, Staff#3 confirmed making one stop to a local pizza shop after leaving the theater. Upon return to the center the staff reported receiving a call from a local police department about a missing child. Interviews with staff revealed a count of fifteen children at the center and one child was determined to be missing. The Staff#1, Staff#2, and Staff#3 were unaware which child was actually missing until another child notified staff. Staff#1 returned to the movie theater to pick Child#1 up. 2. A review of the center's incident form (August 7, 2018) and written notification to parent (August 9, 2018) confirmed the incident involving Child#1 took place. 3. A review of local agency documentation detailed an emergency response of the local police department on August 7, 2018 to a local movie theater due to a child being left unattended. The child was described as presenting with developmental delays as he was unable to provide his name or any other identifiable information in efforts to locate the caregiver. 4. A review of video recording made on August 7, 2018 was conducted on September 17, 2018, the video indicated Child#1 is separated from center's staff for approximately 1hour 12 minutes. Plan of Correction: The staff completed supervision trainings on 9/17/18. The center developed rules and guidelines for field trips to include detailed procedures and a copy of was provided.
Standard #: 22VAC40-185-340-F Complaint related: No Description: Based on interview with staff and local agency representatives, video footage, and review of documentation, the center did not ensure always to ensure children under 10 years of age are within actual sight and sound supervision of staff. Evidence: 1. During the inspection on August 9, 2018, interviews with Staff#1, Staff#2, and Staff#3 confirmed on Tuesday, August 7, 2018 while on a field trip to a local movie theater Child#1, age 4 accompanied them and they were unaware the child was missing until a call from the local authorities was received while at the center at approximately 12:24 pm. The interviews with staff revealed there were three staff and sixteen children present when they arrived at the theater at approximately 10:16 am. 2. A review of the incident report dated August 7, 2018 which confirmed the incident involving Child#1 at the local movie theater. 3. A review of August 7, 2018 video recording at the local movie theater on September 17, 2018 showed the three staff entering with the group of children at approximately 10:20 am, and exiting the movie theater at approximately at 11:34 am. Child#1 was observed separately running in the opposite direction across the lobby and concession stand towards the bathroom area. At approximately 11:38 am, an unidentified female is shown escorting Child#1 to the usher at the box. 4. Interview with a collateral revealed notification of a missing child was received by the usher and the local authorities were contacted immediately. The local representative and local authorities attempted to retrieve information from Child#1 but was unsuccessful. Plan of Correction: The center will implement procedures for sight and sound supervision which include name tags, audio, and color coded shirts, shirts will be provided by the center. The center will ensure staff complete list checks and head counts before, during, and after field trips.
Standard #: 22VAC40-185-580-C Complaint related: No Description: Based on observation, interview with staff, and video footage, the center did not ensure during transportation of children all Virginia state statutes were followed to ensure safety belts and child restraints, and the maximum number of passengers in a a given vehicle shall not be exceeded. Evidence: 1. During the inspection on August 9, 2018, Staff#1, Staff#2, Staff#3 revealed during the field trip on August 7, 2018 sixteen children and three staff were all transported using the center's transportation which is a fifteen passenger van. 2. A review of center's video footage on August 7, 2018 from approximately 11:12 am showed the children and staff exiting center's van in the parking lot. 3. During the inspection on August 9, 2018, there were observation of the inside and outside of the center's van. Plan of Correction: The center will make sure there is only fifteen passengers and ensure all safety belts or restraints are in placed.
