The licensing inspectors completed an inspection in response to a self-reported concern regarding forbidden action that occurred at the center on 07/05/2018. The Department was notified of the incident on 07/09/2018. On 07/13/2018, the licensing inspectors were on site from approximately 9:30 AM until 11:00 AM interviewing staff, conducting observations at the center and reviewing documentation. On 08/15/2018, the licensing inspectors were on site from approximately 1:00 PM until 2:00 PM interviewing staff and conducting observations. Additional interviews were conducted on 07/18/2018, 08/20/2018, 08/31/2018, 09/01/2018 and 09/10/2018. The preponderance of the evidence gathered during the investigation supports areas of noncompliance with the licensing standards related to forbidden action and center?s policies. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Standard #: 22VAC40-185-40-E Description: Based on interviews and documentation review, the center did not maintain compliance with their own policies and procedures required by standards. Evidence: During the inspections and interviews, the following was determined: 1. During the 07/13/2018 inspection, Staff #2 and Staff #3 stated based on an allegation made by Child A (nine years of age) involving Staff #1 they viewed 07/05/2018 video footage of the Older School Age classroom. Staff #2 and Staff #3 stated they viewed Staff #1 putting out an arm but could not see if it hit Child A. Staff #2 and Staff #3 stated the video showed Child A hold her head for a bit. During the 07/18/2018 interview with Child A, Child A stated Staff #1 slapped her in the face. During the 08/15/2018 inspection, Staff #4 and Staff #5 stated based on viewing video footage, Staff #1 was terminated after viewing four separate incidents where the body language of Staff #1 appeared aggressive and frustrated. Staff #5 stated he felt the actions were inappropriate. 2. The center?s Child Discipline Policy states the following: "No child may be subjected to any form of physical (a.k.a. corporal) or verbal punishment by any employee of CNI. This means any rough handling including, but not limited to, shaking, pushing, pulling, pinching, slapping, biting, kicking, spanking, raised voice and/or inappropriate verbal or body language.? Plan of Correction: Additional training was given at our monthly staff meeting after the incident occurred. On Monday the 12th of November we all will have a ?Flip It? training. It will be helpful with our policy of no physical or verbal punishment being used.
Standard #: 22VAC40-185-410-1 Description: Based on interviews and documentation review, the center did not ensure the forbidden action of roughly handling a child did not occur. Evidence: During the inspections and interviews, the following was determined: 1. During the 07/13/2018 inspection, Staff #2 and Staff #3 stated based on an allegation made by Child A (nine years of age) involving Staff #1 they viewed 07/05/2018 video footage of the Older School Age classroom. Staff #2 stated ?I saw [Staff #1] put out an arm as if to say back up but I could not see on the video if [Staff #1] hit Child A.? Staff #2 stated the video showed Child A putting her hand up to her head and holding it for a bit. 2. During the 07/18/2018 interview with Child A, Child A stated on 07/05/2018 she was playing a game with friends. Child A stated Staff #1 asked the name of the game and Child A stated she did not know what is was called. Child A stated Staff #1 said okay and slapped her on the right cheek really hard. Child A stated she walked away and her cheek continued to hurt for about 10 to 20 minutes. 3. During the 08/15/2018 inspection, Staff #2, Staff #3, Staff #4 and Staff #5 stated they did not see Staff #1 slapping Child A on the video footage. Staff #5 stated he viewed the following four separate incidents on the video: ? Staff #1 bent over Child A very close, approximately six inches. Staff #1 stepped back and bumped Child A. ? Staff #1 went to the center of the room with multiple children around. Staff #1 swung her arm around and the body language ?looked frustrated with a stern face.? ? Child A was ?right up on [Staff #1]. [Staff #1] stuck out an arm, very assertive, like saying get back. I didn?t see a hand hit [Child A] but [Child A] put her hand up to her head.? ? Staff #1 and children were dancing in the classroom. Staff #1 bumped out as if part of a dance move. One child was bumped by Staff #1 and the child bumped into Child A and Child A fell down. Staff #5 stated he felt these actions were inappropriate and Staff #1 was terminated based on those actions. 4. On 8/23/2018, the department received written notification that on 8/21/2018, Staff #1 was found guilty of assault and battery of Child A. Plan of Correction: My staff will be reminded at every staff monthly meeting how to properly engage with children when the child is being difficult to handle. The finding of this case is under appeal at this time.
