63.2(17) License & Registration Procedures

Comments:
An unannounced inspection was completed on February 25, 2019 from approximately 9:40a.m. to 11:35a.m. to review areas of non compliance from a previous inspection. One staff record, five corporate officer records, the emergency preparedness plan, polices and procedures, and daily health observation certifications were reviewed. The physical space and the first aid and emergency supplies were also inspected. A consultant was available for interview, the inspection and was present at the exit interview at which time inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left. There were seven citations for violations of the Standards. See the violation notice on the Department's public web site for violations of the Standards. Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it within five business days of receipt. Specify how the deficient practice will be or has been corrected. The plan of correction should contain: 1) step(s) to correct the noncompliance with the standard(s), 2) measure(s) to prevent the noncompliance from occurring again and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Standard #: 22VAC40-185-240-D-6
Description: Based on a review of records and interview, the licensee failed to ensure that the daily health observation training provided to staff included all the required components. Evidence: 1. The daily health and observation training used by the center was reviewed. The curriculum lacked information concerning the Virginia Department of Health Notification of Reportable Diseases and staff occupational health and safety practices in accordance with Occupational Safety and Health Administration's Bloodborne Pathogens regulation. 2. Administrator #1 advised that staff have attempted to take the training that contains all the required elements but the link has not been working.

Standard #: 22VAC40-185-540-C
Description: Based on observation, the licensee failed to maintain all the elements of the required first aid kit and emergency supplies. Evidence: 1. The center's first aid kit and emergency supplies lacked triangular bandages. 2. Administrator #1 acknowledged there are no triangular bandages at the center.

Standard #: 22VAC40-185-550-B
Description: Based on a review of records, the licensee failed to ensure that the emergency preparedness plan shall contain all the required procedural components. Evidence: 1. The center's emergency preparedness plan lacked procedures for drill frequency and plan review and update. 2.Administrator #1 advised she was unaware these elements were missing from the emergency plan.

Description: Based on a review of staff records, the licensee failed to obtain child abuse central registry record checks for one of five applicants of the corporation. Evidence: 1. Applicant #2's record lacked a child abuse central registry search. 2.Administrator #1 advised this has been requested but the results have not been returned yet.

Description: Based on a review of staff records, the licensee failed to obtain child abuse central registry record checks for one of one agents of the corporation.
Evidence: 1. Staff #1's record contained a central registry record check dated August 6, 2018. 2. Therefore, this central registry check was not obtained within the required ninety day time frame of application.

Description: Based on review of staff records, the licensee failed to obtain fingerprint results for one of five applicants of the corporation. Evidence: 1. Applicant #3's record lacked fingerprint results. 2. Administrator #1 advised Applicant #3 has completed the fingerprints but the results have not been received yet.

Description: Based on a review of staff records, the licensee failed to obtain out of state child abuse central registry record checks for one of five applicants of the corporation. Evidence: 1. A review of records revealed that Applicant #4 has resided in Georgia and Alabama in the past five years. Applicant #4's record lacked any out of state central registry record checks. 2. Administrator #1 acknowledged these central registry record checks have not been completed yet.
