22VAC40-191 Background Checks for Child Welfare Agencies
54.1-3408 Must be MAT Certified.
An unannounced complaint inspection was begun October 19, 2016 by two licensing inspectors to investigate information obtained on the same date by the Piedmont licensing office in regards to an infant fatality at the center. The investigation continued on October 20, 2016 and was completed on November 3, 2016. The two inspectors were accompanied on November 3, 2016 by the licensing administrator. The licensing staff interviewed involved staff and reviewed staff files as well as the file of the child. Based on information obtained from interviews as well as observation of the center it was determined that no violation of the church exempt guidelines were found in relation to the child's death. There were other violations cited during the complaint investigation that were not related to the complaint report. The violations were discussed with the director of the center at the exit interview and corrective action will be obtained in the future. Standard #: 22VAC40-191-40-C-2 Complaint related: No Description: Based on a review the center did not obtain background checks on all of the employed staff. Evidence: 1. During the complaint inspection the two inspectors and licensing administrator reviewed three staff files and the following was missing from the staff files: 1. Staff # 2 who was hired 3/12/14 was missing a sworn disclosure form and the criminal history check. Staff # 3 who was hired 8/15/16 was missing a criminal history check and a child protective service check. Staff # 4 who was hired 8/1/16 was missing a criminal history check. Plan of Correction: Background checks, sworn statements and offender checklist now being done.
Standard #: 54.1-3408-O Complaint related: No Description: Based on observation the center administered medication to a child in care without the required medication administration training. Evidence: 1. During the complaint inspection upon arrival at approximately 9:00 AM, two inspectors and the licensing administrator observed staff # 2 administering a breathing treatment to an infant . During discussion with the director it was determined this child's albuterol medication was at the center and was administered to the child. The director as well as a record review for staff # 2 verified that staff # 2 is not trained in medication administration. Plan of Correction: MAT certified teacher hired the next day.
Standard #: 63.2-1716-A-3-a Complaint related: No Description: Based on discussion with the director the center was not using the correct staff to child ratio in all classrooms. Evidence: 1. During the complaint inspection the director stated she had been using a ratio of one staff to six children in the age category of one year old children through 23 months. The day of the first inspection, the director and two inspectors discussed the schedules of staff and numbers of children in attendance that day and it was determined that there were eight children in this age group for part of the morning time with staff # 5. The attendance sheet for this classroom was also viewed by an inspector. Plan of Correction: Hired new staff (before inspection was even done.)
Standard #: 63.2-1716-A-4 Complaint related: No Description: Based on review of staff files the center did not obtain the required physicals on all employed staff who supervise children. Evidence: 1. During the complaint inspection the two inspectors and licensing administrator reviewed three staff files and staff # 3 who was hired 8/15/16 did not have a physicial statement in the file. Plan of Correction: Physical forms are being done through the hospital.
