22VAC40-191 Background Checks for Child Welfare Agencies

Comments:
Licensing Inspector arrived on April 26, 2018 at 9:48am and departed at 3:00pm to conduct a Subsidy Health and Safety Inspection. Upon arrival to the facility, there were 27 children present with seven staff members, ranging in age from 19 months to four years old. Additional staff were on site for administrative and support purposes. The children were observed passing out water to members of the community, listening to a Bible story, doing an arts and crafts activity and napping. The sample size consisted of five children's records and six staff records were reviewed.

Violations:
Standard #: 22VAC40-191-40-C-2
Description: Based on record review, in two of six staff records reviewed, the center did not ensure that all required background checks were in each staff person's record. Evidence: During the inspection conducted on April 26, 2018, the following background check information was no t documented in each staff member's record: 1. There was no documentation of a Sworn Statement or Affirmation in the record for Staff #1 (date of hire 3/21/18). 2. There was no documentation of a search of the Central Registry in the record for Staff #1 and Staff #2 (date of hire 10/17).

Plan of Correction: The staff members will fill out all paperwork.

Standard #: 63.2-1716-A-4
Description: Based on review, in one of five staff records reviewed, the facility did not ensure that in each person in a supervisory position has been certified by a practicing physician to be free from any disability which would prevent him from caring for children under his supervision. Evidence: During the inspection conducted on April 26, 2018, there was no documentation that Staff #1 and Staff #2 had been certified by a practicing physician to be free from any disability which would prevent him from caring for children under his supervision.

Plan of Correction: The staff will obtain physicals.

Standard #: 63.2-1716-A-6
Description: Based on review, the facility did not ensure that the following aspects of the child day center's operations are described in a written statement provided to the parents or guardians of the children in the center and made available to the general public: physical facilities, enrollment capacity, food services, health requirements for the staff and public liability insurance. Evidence: During the inspection conducted on April 26, 2018, the following aspects of the center were not described in a written statement provided to the parents or guardians and made available to the general public: physical facilities and public liability insurance.

Plan of Correction: The parent handbook will be updated tomorrow.

Standard #: 63.2-1720.1-B-2
Description: Based on record review, in two of six staff records reviewed, the facility did not ensure that staff have all required background checks in their record. Evidence: During the inspection conducted on April 26, 2018, there were no fingerprint results for Staff #1 (hire date 3/21/18) who was observed working on the date of the inspection and no criminal record clearance results for Staff #2 (hire date 10/17).

Plan of Correction: We will submit the forms for new staff.
