22VAC40-111 Care of Children
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 10/27/2015. Observations were made and interviews were conducted with children, the caregiver and parents of the children. The preponderance of the evidence gathered during the investigation supports the allegations regarding physical environment; therefore, the complaint is determined to be valid. Areas of non-compliance are identified on the violation notice. The investigation was conducted jointly with the local agency. Standard #: 22VAC40-111-240-A Complaint related: Yes Description: Based on observation, the family day home failed to maintain the home in a clean, safe and operable condition. Evidence: 1. The inspector observed the following in the home: the entrance room which is primarily used for child care was cluttered with several items on the floor, under the table and on the table limiting space for children's activities; the floor in the kitchen was dirty with dust and debris. Plan of Correction: Items have been removed from the top of the table and under the table. The kitchen floor has been cleaned. The floors in the entrance room and the kitchen will be swept daily and mopped weekly or more often as needed. The provider will keep clutter off the tables and floors.
Standard #: 22VAC40-111-260-E Complaint related: No Description: Based on observation, the family day home failed to empty a bucket of water immediately after use. Evidence: 1. The inspector observed a bucket of mop water sitting in the kitchen floor upon arrival at the family day home. The bucket of mop water remained sitting in the kitchen floor during the inspection. The inspection lasted from 2:10pm to 4:35pm. Plan of Correction: The provider will no longer mop while the children are in care.
Standard #: 22VAC40-111-370-A Complaint related: Yes Description: Based on observation, the family day home failed to keep the home free from insect infestation. Evidence: 1. The inspector observed 3 or 4 dead roaches behind a cabinet in the entrance room which is primarily used for child care. The inspector observed one live roach on the wall in the kitchen. The provider is currently under contract with an exterminator and the home has had monthly treatments; however, extra cleaning has not been done to keep the home as safe as possible until all of the insects are exterminated. Plan of Correction: The cabinet has been moved out and was cleaned behind it. The exterminator is continuing monthly treatments and the last treatment was on 11/18/15. The provider will sweep the floors each morning before the children come into care to make sure there are no dead roaches in the floor.
Standard #: 22VAC40-111-460-I Complaint related: Yes Description: Based on observation, the family day home failed to keep animal litter boxes inaccessible to children. Evidence: 1. The inspector observed a cat litter box in the kitchen floor. There is a gate that separates the kitchen from the entrance room which is primarily used for child care; however, the gate was opened allowing children access to the litter box. Plan of Correction: The litter box has been removed and there are no litter boxes in the house at this time. The provider's cats are staying outside and will only be brought into the house with extreme cold weather. If a litter box is put back in the house, it will be in a room that the children do not have access to.
Standard #: 22VAC40-111-460-J Complaint related: Yes Description: Based on observation, the family day home failed to remove animal excrement promptly from the home. Evidence: 1. The inspector observed a cat litter box in the kitchen floor. The litter box contained animal feces and was only removed after the inspector brought it to the provider's attention. Plan of Correction: The litter box has been removed. If a litter box is put back into the home, it will be put in a room that the children do not have access to and it will be cleaned promptly.
Standard #: 22VAC40-111-510-A Complaint related: No Description: Based on observation and interview, the family day home failed to provide each child an individual cot, rest mat, or bed for napping. Evidence: 1. Upon arrival at the family day home, the inspector observed two children (a 2 year old and a 4 year old) napping on the sofa in the entrance room. 2. The inspector asked the provider why the children were napping on the sofa and the provider said, "they just fell asleep there, they usually nap on mats." Plan of Correction: The children have mats to nap on and will use them at nap time. If a child falls asleep on the sofa, they will be moved to a mat.
