A joint investigation was conducted with another agency in response to an incident that was self reported. The Licensing Inspector reviewed staff and child record, observed classroom, and interviewed staff and child. Based on the investigation, a violation was cited. Description: Based on interviews, staff failed to provide behavioral guidance that is constructive in nature, age and stage appropriate and shall be intended to redirect the child to appropriate behavior. Evidence: On May 19, 2015 staff #2 had to speak with child #1 about some behavioral issues. Staff #2 checked on the child in the afternoon and found the child, age 3 sitting in the classroom looking upset. Staff #1 said that the child had been throwing bean bags and had hit staff #1 twice. Staff #2 took the child into the hall to talk, staff #2 asked the child if he was throwing things at his teacher. He said yes, I don't like that teacher. The child then said,"well she hit me and my arm is red". Staff #2 looked at the child's arm, which was pink in color above the elbow. The child said, "she threw the bean bag at me". Staff #3 and #4 interviewed staff # 1 and when asked what happened, staff #1 made a throwing motion and said, I was showing him that it hurt. Staff #1 said, he was throwing the bean bags at me, and I said to him "how does that feel". Child #1 was interviewed and said that staff #1 threw a bean bag and hit his arm by the elbow. The child said, "it changed color to pink and later it turned back to tan, my color". Staff #1 was interviewed and said that the child was throwing bean bags, "The child then threw a bean bag at me". "I threw one at him to distract him, he started crying".

Plan of Correction: Retrain, train all staff on Positive Guidance. (6-10-15) Terminated staff immediately. (5-19-15)
