A complaint investigation has been completed at the facility. The inspector interviewed staff, reviewed records, and observed classes in response to allegations of ratio problems, forbidden action, behavior guidance, and communicable disease reporting. Based on the evidence gathered, the licensee has deemed the allegations to be valid and Violations have been issued to the center. Standard #: 22VAC40-185-340-A Complaint related: No Description: Based on staff interviews and record review, the center failed to ensure staff always protect the children in attendance when the center had a staff stay with a group of children even though the center management was made aware the staff member was sick with strep. Evidence: 1. Inspector started to ask a staff about the children in her care and noticed the staff had trouble talking. Inspector asked the staff if she was okay and was told that she was at the Doctor's last night and she learned she had strep throat. The staff was hoping she could go home soon. 2. While in the Director's office, the Inspector reviewed the Doctor's note for that staff member and it read that she was seen at 9 pm on May 6, 2014 and that she should stay home until May 8, 2014. When the Inspector asked the acting Director about the sick staff member, she stated she knew but had no one who could cover her class. Plan of Correction: Employees who are diagnosed with any illness must notify management and will not be allowed in the workplace. Employees who become ill while at work will be excused from completing their shift and replaced by support staff. Employees are required to bring a doctor?s clearance note to return to work.
Standard #: 22VAC40-185-350-C Complaint related: Yes Description: Based on observation and record review, the center has been over ratio in the toddler group on 4 occasions in the last 5 days and the two's group was over ratio for 10 days. Evidence: 1. Infant ratio is 4 to 1. In the last 5 days, during the morning, staff placed two infants ( 11 months old and 14 months old) in the toddler room which had 3 toddlers in the room with 1 staff member. The 5 to 1 staff was over ratio because infants require a ratio of 4 to 1. 2. Staff interviews revealed the two's group was over ratio for 10 consecutive days when a toddler was placed in the two's group. The head count sheet confirmed there were eight days of 8 to 1 and 2 days of 9 to 1 in that group from April 20 through May 1st and the sheet lists the toddler as being in the class on those dates. Plan of Correction: Management has reviewed staffing as well as ratios in all classrooms. Management has corrected the deficiencies and has developed a weekly schedule to accommodate any changes in staffing and to ensure compliance. Staff has been made aware of required ratios and has been instructed to contact management once their class is one child away from reaching mandated ratio compliance. Management is actively recruiting for new, qualified staff.
Standard #: 22VAC40-185-400-A Complaint related: Yes Description: Based on staff interviews, the staff failed to promote children's physical, intellectual, emotional, and social well-being and growth, when two staff interacted with one another in a manner that did not provide needed help, comfort, and support. Evidence: 1. Staff were interviewed about an incident in which two staff argued in front of the preschool class. Staff stated one staff opened the infant door to say something to another staff about an earlier conversation. Staff 1, in the preschool group, told her she had nothing to say and staff #2 was seen slamming the door. Staff 1 was then seen opening the door into the infant room and telling staff #2 she better not do that again or she will drop her. 2. Staff 1 was interviewed and admitted to getting upset with staff 1 and stated she told her not to that again or she would drop her. Plan of Correction: Review the staff?s responsibility to maintain the code conduct and to promote children?s physical, intellectual, emotional and social well-being and growth through positive behavior. Management will set aside a time and place to resolve any disagreements between staff members in a calm and respectable manner.
Standard #: 22VAC40-185-410-1 Complaint related: Yes Description: Based on staff interviews, a staff member has used threatening language towards children in the preschool room. Evidence: 1. Five staff interviewed in regards to an allegation that staff #3 has been telling children that if they don't behave, she will let a green monster come out of the closet. 2. Three staff were asked if they were aware that a staff member was telling the children she would let a green monster out of the closet. One staff said she heard staff talk about the green monster and two staff stated they heard staff #3 say it to kids and it was to get them to behave. Plan of Correction: All staff will be re-trained on positive guidance to respect and protect children through redirection and praising good behavior. A written communication of the center?s policy on unacceptable child guidance will be given to each teacher along with a review of the training of the responsibilities of being a mandated reporter to protect all children.
Standard #: 22VAC40-185-490-C Complaint related: Yes Description: Based on staff interviews, the center failed to notify the parents that the children were exposed to a communicable disease listed in the current communicable disease chart. Evidence: 1. Staff interviewed acknowledged that a child went home on Friday, May 1st. The staff stated the parent called later to say the child had Scarlet Fever. 2. Staff interviewed stated that they did not put up a note about the illness on the following work day. Plan of Correction: All parents and staff are notified by letters of any communicable diseases listed in the disease chart.
