63.2 Child Abuse and Neglect

Comments:
Today's visit was an investigation regarding a self reported incident of a child found alone on the center's playground. The reported incident took place on 10/16/15. The incident was reported to the Licensing Inspector on 10/20/15 during a complaint investigation that was also taking place on the same day. The investigation was conducted in conjunction with the local agency responsible for investigating suspected abuse or neglect of a child. During the investigation all staff reported to be involved in the incident were interviewed. Based on the preponderance of evidence the self-reported incident has been determined to be "valid". A Violation Notice was issued during the inspection due to non-compliance. The center has requested a ten day review of the Violation Notice. The notice is due back in the office no later than the close of business day on 11/23/2015. Thank you for your time, please call me at 309-2051 if you have any questions.

Standard #: 22VAC40-185-40-E
Description: Based on the inspector's investigation during a self reported incident of a child found alone on the center's playground, the center failed to maintain compliance with the center's own policies and procedures that are required by these standards. Evidence: A procedure for identifying where children are at all times is required by standard 22VAC40-185-240-B-3. The center failed to ensure the center's procedures for identifying where attending children are at all times were followed. A child was found alone on the playground used by children toddler through three years of age on 10/16/15 demonstrating a breach of a required procedure.

Plan of Correction: Staff will be reminded of proper policy and procedures that must be adhered to in order to maintain compliance. Additional training will be provided to all staff.

Standard #: 22VAC40-185-340-F
Description: Based on an investigation of a self-reported incident of a child being found alone on the small playground used for younger children in care, the center failed to maintain actual sight and sound supervision of child under the age of ten years. Evidence: The center reported a child was found alone on the small playground used by the toddler through three year old children in care on Friday, October 16th. A child three years of age was found by staff member #3 alone on the small playground, located on the left side of the building. Staff member #4 identified a child was not within the group upon entering the building from the outdoor playground. The communication log, used for attendance purposes, was reviewed by staff member #4 and child #1 was identified as not being within the group. Staff member #4 left staff member #2 with the Red Bears II group and began to search the neighboring classrooms on the same end of the building for child #1. Staff member #4 saw staff member #3 seated in the main entrance area of the center and asked her to go outside to check the playground for child #1. Staff member #3 found child #1 alone on the playground. The estimated time frame from when the child was identified as missing from the designated group, until the child was returned to the group, is four minutes. Children under ten years of age always shall be within actual sight sound supervision of staff.

Plan of Correction: All staff will be reminded of the importance of maintaining sight and sound supervision of children at all times. Additional training will be provided to all staff to ensure that proper policy and procedures regarding sight and sound supervision are followed on a daily basis in order to maintain compliance.
